Ratificira se Memorandum o soglasju med vladami Češke republike, Republike Madžarske, Republike Poljske, Slovaške republike, Republike Slovenije in Programom Združenih narodov za nadzor nad mamili, podpisan v Pragi 5. oktobra 1995.

PREAMBLE

1. Recent rapid and substantive changes in the societies and the economies of the countries of Central Europe have been accompanied by significant increases in drug abuse and in the illicit trafficking, cultivation and production of narcotic drugs and psychotropic substances and diversion of precursors and essential chemicals.

I. GOVERNMENT COMMITMENT

2. Concerned about the impact of drug abuse and illicit trafficking on the health, social welfare and security of the population of the sub-region, the Governments have accordingly responded by increasing their efforts. The Governments re-affirm their commitment to take further effective action to prevent drug abuse, including local involvement at the community level, and to combat illicit trafficking and drug-related crime within their national territory.
    3. The Governments recognize that the elaboration of comprehensive, balanced and wellcoordinated national drug control policies, strategies and plans are essential to the success of national efforts. The Governments therefore intend to elaborate such policies, strategies and plans where they do not exist, and to strengthen those that do exist and to provide adequate financial and human resources to implement them.
    The Governments may wish to consult with, and seek assistance of, UNDCP to do so.
    4. The existence of an inter-ministerial coordinating body for the planning and coordination of drug control efforts is essential for the effective implementation of national drug control policies as recommended in the Comprehensive Multi-disciplinary Outline of Future Activities in Drug Abuse Control. The Governments consider that priority attention should be given to the establishment or strengthening of such a body in each country.
    5. Recognizing the importance of international cooperation in combating the drug problem, the Governments have been actively cooperating on the international level, inter alia, in the context of the Commission on Narcotic Drugs and the Council of Europe. The 1994 Berlin Declaration on Increased Cooperation in Combating Drug Crime and Organized Crime in Europe was a further demonstration of commitment to increased cooperation.

II. SUBREGIONAL AGENDA FOR ACTION

6. The Governments are convinced that cooperation at the sub-regional level should have a significant and effective impact on reducing drug abuse and illicit trafficking in their respective countries. The Governments recognize the important role which UNDCP and other international organizations have to play in fostering and supporting such cooperation. For its part, UNDCP is committed to assisting the Governments in this regard.
    7. The following priority areas have been identified for the development of specific sub-regional programmes, projects or activities to be undertaken jointly by the Governments:
    i. Analysis of the economic and social consequences of drug abuse and evaluation of the impact of drug control policies.
    ii. Training of responsible officials in state administrations and of policy administrators and facilitators.
    iii. Sharing of information among national drug control coordinating bodies and exhange of information on legislation.
    iv. Promotion of national drug intelligence units.
    v. Combined efforts against illicit drug traffic.
    vi. Elaboration of sub-regional training programmes on specific issues related to controlled delivery techniques/precursor control and informant handling/undercover operations.
    vii. Training of drug treatment and rehabilitation professionals within ongoing programmes as well as through the promotion of new programmes.
    viii. Standardization of basic indicators and training on new methodologies for data collection and research on drug abuse.
    ix. Elaboration of drug preventive education components for national school curricula and sharing of experience.
    x. Redefinition of treatment and rehabilitation services and adoption of new approaches to better respond to the needs of drug abusers.

III. CONTRIBUTIONS BY THE GOVERNMENTS AND UNDCP

8. The Governments express their willingness to provide political, financial and technical support to joint programmes, projects and activities on a cost-sharing basis in volumes which take into account national capabilities and interests. UNDCP confirms its readiness to consider supporting these initiatives through the elaboration of technical cooperation projects, as appropriate.

IV. ORGANIZATIONAL MATTERS

9. The implementation of sub-regional programmes, projects and other activities prepared pursuant to this Memorandum shall be subject to approval by the Governments participating in the respective programme, project or activity.
    10. In order to facilitate periodic review of the implementation of the sub-regional cooperation under the present Memorandum, the Governments agree to host, on a rotational basis, an annual meeting, in cooperation with UNDCP. The Governments and UNDCP may agree to alternate arrangements for holding the annual meeting. The meeting will review the results of collaboration efforts and identify and promote new activities. The meeting will be attended by policy level officials authorized by the Governments and by UNDCP.
    11. If the circumstances so require, and when agreed upon by the Governments and UNDCP, representatives of other countries and international organizations may be invited to attend the annual meeting.

V. AMENDMENTS TO THE MEMORANDUM

12. With the mutual consent of all Governments and UNDCP, this Memorandum of Understanding may be extended to include other types of collaborative drug control measures. Governments of other countries may be invited to join the present Memorandum of Understanding if and when agreed upon through mutual consultations by the Governments signatories of the Memorandum of Understanding and UNDCP. Any such changes will be reflected in mutually agreed upon written revisions to this Memorandum of Understanding.

VI. CONDITIONS OF WITHDRAWAL

13. Any Government and UNDCP may withdraw from this Memorandum of Understanding by providing a six month written notice to that efect to the others.
    14. In witness whereof, the Governments and UNDCP sign the present Memorandum in six copies.

1. Nedavne hitre in bistvene spremembe v družbi in gospodarstvih držav Srednje Evrope so povzročile znatno povečanje zlorabe mamil in ilegalnega prometa, proizvodnje in pridelave narkotikov in psihotropnih snovi ter raznolikost prekurzorjev in kemičnih sestavin za izdelavo mamil.

2. Zaskrbljene zaradi posledic, ki nastanejo zaradi zlorabe mamil in ilegalnega prometa in vplivajo na zdravje, socialno varnost in varnost prebivalcev v podregiji, so se vlade odzvale tako, da so okrepile svojo dejavnost, potrdile svoja prizadevanja glede nadaljnjih učinkovitih akcij za preprečevanje zlorabe mamil, pri čemer bi se vanje vključevali lokalni dejavniki na občinski ravni, in se obvezale, da se bodo borile proti nezakonitemu prometu in kriminaliteti mamil na svojem ozemlju.

3. Vlade ugotavljajo, da je za uspešno nacionalno prizadevanje potrebno nujno pripraviti obsežno uravnoteženo in temeljito usklajeno nacionalno politiko za nadzor nad mamili. Zato nameravajo vlade okrepiti oziroma določiti politiko, strategijo in načrte tam, kjer le-ti še ne obstajajo, ter zagotoviti ustrezne finančne in človeške vire za njihovo izvajanje.

Vlade se v ta namen lahko z UNDCP posvetujejo in prosijo za pomoč.

4. Kot priporoča obsežni “Multidisciplinarni pregled bodočih dejavnosti za nadzor nad zlorabo mamil”, je obstoj medsektorskega koordinacijskega telesa za načrtovanje in usklajevanje nadzora nad mamili nujen pogoj za učinkovito izvajanje državne politike na področju nadzora nad mamili. Vlade menijo, da mora biti ustanovitev in krepitev takšnega telesa v vsaki državi prednostna naloga.
