Neposredni učinek direktiv v pravu EU obstaja že celih pet desetletij, kljub temu pa se v teoriji in praksi Sodišča EU in nacionalnih sodišč še naprej poraja več odprtih vprašanj. Ta zadevajo vir, obseg in pravne posledice neposrednega učinka direktiv v prepletu s temeljnima načeloma primarnosti in lojalnosti do prava EU. Avtor meni, da so razlogi za tako stanje večplastni in da svojo vsebino črpajo že iz različnih teoretičnih pogledov na pravno zasnovo EU kot celote. Razprava je posledično sestavljena iz treh delov. Avtor najprej predstavi teoretična razhajanja o pomenu in pravnih posledicah neposrednega učinka direktiv. Nato analizira razvoj tega temeljnega načela prava EU v sodni praksi Sodišča EU. Nazadnje pa opozori še na nekatere očitno pravno zmotne sodbe slovenskih sodišč, ki so napačno razumela sodno prakso Sodišča EU na tem področju.

The direct effect of directives, which has existed in EU law for five decades, continues to raise numerous unanswered questions in theory and practice, both before the CJEU and national courts. These questions relate to the source, scope, and legal implications of the direct effect of directives, intertwined with the fundamental principles of primacy and loyalty to EU law. The author contends that the reasons for this situation are multifaceted and that they stem from various theoretical perspectives on the legal design of the EU as a whole. Accordingly, this discussion is structured in three parts. Firstly, the paper presents the theoretical divergences on the meaning and legal consequences of the direct effect of directives. It then analyses the development of this fundamental principle of EU law in the case-law of the CJEU. Finally, it draws attention to some manifestly legally erroneous judgments of the Slovenian courts which have misunderstood the case-law of the CJEU in this area.
