Agencija se ustanovi za opravljanje razvojnih, strokovnih in regulatornih nalog v javnem interesu. Pristojnosti javne agencije za izdajanje predpisov določa zakon. Splošne akte za izvrševanje javnih pooblastil izdajajo praviloma sveti agencij. Splošni akti agencij imajo lastnost pravnih predpisov, ki jih sicer izdajajo ministri. Zato so splošno obvezni in zadevajo nedoločeno število subjektov, objavljajo se v Uradnem listu Republike Slovenije, njihovo ustavnost in zakonitost pa presoja Ustavno sodišče.

An agency may be established to perform development, technical and regulatory functions in the public interest. The competence of a public agency to issue regulations must be laid down in a law adopted by the parliament. General legal acts for the exercise of the agency’s public posers are as a rule issued by the agencies’ councils. The agencies’ general legal acts have the same character as the rules and regulations issued by the ministers. Therefore, they are compulsory, they concern an indeterminate number of entities, they must be published in the Official Gazette of the Republic of Slovenia, and their constitutionality and legality may be reviewed by the Constitutional Court.
