POVZETEK
Za presojo pravic kupca v stečajnem postopku nad prodajalcem stanovanja so pomembna pravila insolvenčnega prava o ločitvenih in izločitvenih pravicah ter o vzajemno neizpolnjenih dvostranskih pogodbah. Med ločitvene pravice spadajo zastavna in pridržna pravica ter pravica fiduciarja pri prenosu lastninske pravice v zavarovanje. Obstoj in vsebina izločitvene pravice sta odvisna od vrste premoženja, ki je predmet te pravice (premičnine, nepremičnine, fiduciarna razmerja). Za položaj pri vzajemno neizpolnjeni dvostranski pogodbi veljajo nekatera posebna pravila, zato za terjatev ne nastanejo običajne materialnopravne posledice začetka stečajnega postopka. Članek preučuje način uresničevanja in tipične položaje pri uporabi navedenih institutov pri gradnji in prodaji stanovanj ob upoštevanju posebnih pravil prava varstva potrošnikov pri prodaji novogradenj.
SUMMARY
For the assessment of customer rights in bankruptcy proceedings against the seller of housing, the rules of insolvency law on separation rights, exclusion rights, and on mutually unfulfilled bilateral contracts are important. Separation rights arise out of lien, retention, and the trustee’s rights on property transferred as collateral. The existence and content of exclusion rights depends on the type of property that is subject to these rights (movables, real estate, fiduciary property). The situation in reciprocally unfulfilled bilateral agreement unfulfilled is subject to certain special rules, so the standard effects of the introduction of bankruptcy proceedings do not apply. This article examines the manner of exercising, and the typical positions in application of these instruments in the construction and sale of housing, taking into account the special rules on the protection of consumers in the sale of new of new apartments.
