V šoli se pravice staršev, da izobražujejo in vzgajajo svoje otroke, srečajo z izobraževalnovzgojnim pooblastilom, ki ga je šoli podelila država. Razmerja med starši, šolo in državo zadevajo tudi pravice otroka. Ne bi bilo naravno, če bi država, šola, starši in otrok oblikovali svoja medsebojna razmerja povsem nekonfliktno, toda na redkokaterem področju družbenega življenja se tako jasno pokažejo konfliktni potenciali v odnosih med otroci, starši in državo kot na področju šolstva. Pri vsej množici teorij in pogledov v zvezi s številnimi problemi glede pravic staršev in njihovih otrok pa je danes na področju šolskega prava razbrati eno samo zares pomembno interpretacijsko pravilo: korist otroka.

In the school parental rights to educate and to bring up their children meet the state mandate of the school to educate and to bring up their pupils. The relations between parents, school and state also concern children’s rights. It is unusual when the state, the school, parents and the child create their relationship fully without conflicts, but there are not many areas of social life where the conflicts between children, parents and the state are so clearly manifested as in the school system. For solution of these conflict relations it is of great importance to follow the principle of the child benefit.
