V prispevku avtor ugotavlja vpliv sodišč (predvsem ustavnih in vrhovnih – s poudarkom na ustavnosodni presoji Ustavnega sodišča Republike Slovenije) na vsebino načela socialne države. Primarno se sicer vsebina oblikuje v okviru zakonodajne funkcije oblasti, vendar avtor zagovarja stališče, da je vpliv sodišč na vsebino načela socialne države vse prej kot zanemarljiv kar predstavi tudi s pomočjo nekaterih odločitev Ustavnega sodišča RS. Dotakne se vprašanj o razmerju med načelom socialne države in ostalimi načeli, ki sta jih je z njegovo pomočjo razvila judikatura in pravna teorija (predvsem njihova medsebojna povezanost, hierarhičen odnos in časovna komponenta), sistema socialne države, dometa razlag načel(a) in njihovega dejanskega vpliva, narave ustavnosodne presoje (zadržana ali evolutivna). Avtor skozi razpravo potrdi sklep, da ustavna sodišča vplivajo na vsebino načela socialne države.

Author discusses courts influence (primarily constitutional and supreme – with the emphasiss on the constitutional review of the Constitutional Court of Republic of Slovenia) on the content of the social state principle. Primarily the content is formed in the frame of the legislative and executive power, but in the authors opinion the influence of the courts on the content of the social state principle is far from neglectable, which he represent mostly through the judicature of the slovenian Constitutional court. He discusses questions regarding the relation between the social state principle and other principles that derive from it and have been developed by the judicature and legal theory (mostly in their interconnection, hierarchy and time component aspect), social state system, influence and impact of interpretations of the social state principle, nature of the (constitutional) judicial review (restraintive or evolutive). Author concludes that the constitutional courts do in fact have influence on the content of the social state principle.
