POVZETEK
Pristojnost državnega organa označuje njegovo delovno področje, ki ga opravlja v državni organizaciji in ki ga je upravičen in zavezan opravljati. Pravno gledano se pristojnosti temeljnih državnih organov razlikujejo med seboj predvsem po pravnih aktih, ki jih sprejemajo. Pristojnosti državnih organov se izvajajo v okviru delitve oblasti na zakonodajno, izvršilno in sodno, pa tudi na podlagi delitve oblasti med dvema ravnema državne organiziranosti. Podobno je v Evropski uniji, kjer se oblast kot celota izvaja na ravni držav in tudi na ravni EU. Zaradi tega se normativna dejavnost države, ki je članica EU, giblje v mejah lastne ustavne ureditve in v mejah pravne ureditve EU. Posledica sta dve vrsti predpisov države, namreč predpisi, ki jih država sprejema izključno v okviru svoje lastne pristojnosti, pri čemer je omejena samo s svojo ustavo, in predpisi, ki jih sprejema na podlagi in v okviru evropskih predpisov za uresničevanje teh predpisov, vendar tudi na podlagi in v okviru lastne ustavne ureditve. To razlikovanje je pomembno ne samo z vidika vsebine predpisa, temveč tudi z vidika nomotehnike.
SUMMARY
The jurisdiction of a state body indicates the field of work within the state organisation that the body is entitled and obliged to perform. Legally speaking, the powers of basic state bodies distinguish themselves primarily in terms of legal acts that they may adopt. The powers of state authorities are carried out under the separation into a legislative, an executive and a judicial branch, well as on the basis of separation of powers between the two levels of state organization. Similarly, in the European Union, authority as a whole is exercised both nationally and at the EU level. For this reason, the regulatory activity of an EU Member State is carried out within the framework of its constitutional arrangements and in the context of the EU regulation. This results in two categories of state regulations. The first category comprises rules that the state adopts only within its own jurisdiction, whereby it is bound only by its own constitution. The second category encompasses rules that the state adopts on the basis and in the framework of European regulations, for the implementation of these regulations, but at the same time, also on the basis of and within its own constitutional arrangements. This distinction is important not only in terms of the content of regulation, but also in terms of nomotechnics.
