Razglašam Zakon o ratifikaciji Severnoatlantske pogodbe (MSAP), ki ga je sprejel Državni zbor Republike Slovenije na seji 24. februarja 2004.

O RATIFIKACIJI SEVERNOATLANTSKE POGODBE (MSAP)

1. člen

Ratificira se Severnoatlantska pogodba, podpisana v Washingtonu 4. aprila 1949, kakor je bila dopolnjena s:
– Protokolom o pristopu Grčije in Turčije k Severnoatlantski pogodbi, podpisanim v Londonu 17. in 22. oktobra 1951;
– Protokolom o pristopu Zvezne republike Nemčije k Severnoatlantski pogodbi, podpisanim v Parizu 23. oktobra 1954;
– Protokolom o pristopu Španije k Severnoatlantski pogodbi, podpisanim v Bruslju 10. decembra 1981;
– Protokolom o pristopu Češke republike k Severnoatlantski pogodbi, podpisanim v Bruslju 16. decembra 1997;
– Protokolom o pristopu Republike Madžarske k Severnoatlantski pogodbi, podpisanim v Bruslju 16. decembra 1997;
– Protokolom o pristopu Republike Poljske k Severnoatlantski pogodbi, podpisanim v Bruslju 16. decembra 1997;
– Protokolom o pristopu Republike Bolgarije k Severnoatlantski pogodbi, podpisanim v Bruslju 26. marca 2003;

2. člen

Besedilo Severnoatlantske pogodbe se v izvirniku v angleškem jeziku in prevodu v slovenski jezik glasi:
NORTH ATLANTIC    
TREATY

The Parties to this Treaty reaffirm their faith in the purposes and principles of the Charter of the United Nations and their desire to live in peace with all peoples and all governments.
    They are determined to safeguard the freedom, common heritage and civilization of their peoples, founded on the principles of democracy, individual liberty and the rule of law.
    They seek to promote stability and well-being in the North Atlantic area.
    They are resolved to unite their efforts for collective defense and for the preservation of peace and security.

They therefore agree to this North Atlantic Treaty:

Article 1

The Parties undertake, as set forth in the Charter of the United Nations, to settle any international disputes in which they may be involved by peaceful means in such a manner that international peace and security, and justice, are not endangered, and to refrain in their international relations from the threat or use of force in any manner inconsistent with the purposes of the United Nations.

Article 2

The Parties will contribute toward the further development of peaceful and friendly international relations by strengthening their free institutions, by bringing about a better understanding of the principles upon which these institutions are founded, and by promoting conditions of stability and well-being. They will seek to eliminate conflict in their international economic policies and will encourage economic collaboration between any or all of them.

Article 3

In order more effectively to achieve the objectives of this Treaty, the Parties, separately and jointly, by means of continuous and effective self-help and mutual aid, will maintain and develop their individual and collective capacity to resist armed attack.

Article 4

The Parties will consult together whenever, in the opinion of any of them, the territorial integrity, political independence or security of any of the Parties is threatened.

Article 5

The Parties agree that an armed attack against one or more of them in Europe or North America shall be considered an attack against them all; and consequently they agree that, if such an armed attack occurs, each of them, in exercise of the right of individual or collective self-defense recognized by Article 51 of the Charter of the United Nations, will assist the Party or Parties so attacked by taking forthwith, individually and in concert with the other Parties, such action as it deems necessary, including the use of armed force, to restore and maintain the security of the North Atlantic area.
    Any such armed attack and all measures taken as a result thereof shall immediately be reported to the Security Council. Such measures shall be terminated when the Security Council has taken the measures necessary to restore and maintain international peace and security.

Article 6

For the purpose of Article 5 an armed attack on one or more of the Parties is deemed to include an armed attack on the territory of any of the Parties in Europe or North America, on the Algerian departments of France, on the occupation forces of any Party in Europe, on the islands under the jurisdiction of any Party in the North Atlantic area north of the Tropic of Cancer or on the vessels or aircraft in this area of any of the Parties.

Article 7

This Treaty does not affect, and shall not be interpreted as affecting, in any way the rights and obligations under the Charter of the Parties which are members of the United Nations, or the primary responsibility of the Security Council for the maintenance of international peace and security.

Article 8

Each Party declares that none of the international engagements now in force between it and any other of the Parties or any third state is in conflict with the provisions of this Treaty, and undertakes not to enter into any international engagement in conflict with this Treaty.

Article 9

The Parties hereby establish a council, on which each of them shall be represented, to consider matters concerning the implementation of this Treaty. The council shall be so organised as to be able to meet promptly at any time. The council shall set up such subsidiary bodies as may be necessary; in particular it shall establish immediately a defense committee which shall recommend measures for the implementation of Articles 3 and 5.

Article 10

The Parties may, by unanimous agreement, invite any other European state in a position to further the principles of this Treaty and to contribute to the security of the North Atlantic area to accede to this Treaty. Any state so invited may become a party to the Treaty by depositing its instrument of accession with the Government of the United States of America. The Government of the United States of America will inform each of the Parties of the deposit of each such instrument of accession.

Article 11

This Treaty shall be ratified and its provisions carried out by the Parties in accordance with their respective constitutional processes. The instruments of ratification shall be deposited as soon as possible with the Government of the United States of America, which will notify all the other signatories of each deposit. The Treaty shall enter into force between the states which have ratified it as soon as the ratifications of the majority of the signatories, including the ratifications of Belgium, Canada, France, Luxembourg, the Netherlands, the United Kingdom and the United States, have been deposited and shall come into effect with respect to other states on the date of the deposit of their ratifications.

Article 12

After the Treaty has been in force for ten years, or at any time thereafter, the Parties shall, if any of them so requests, consult together for the purpose of reviewing the Treaty, having regard for the factors then affecting peace and security in the North Atlantic area, including the development of universal as well as regional arrangements under the Charter of the United Nations for the maintenance of international peace and security.

Article 13

After the Treaty has been in force for twenty years, any Party may cease to be a party one year after its notice of denunciation has been given to the Government of the United States of America, which will inform the Governments of the other Parties of the deposit of each notice of denunciation.

Article 14

This Treaty, of which the English and French texts are equally authentic, shall be deposited in the archives of the Government of the United States of America. Duly certified copies thereof will be transmitted by that Government to the Governments of the other signatories.
     
    In witness whereof, the undersigned Plenipotentiaries have signed this Treaty.
     
    Done at Washington, the fourth day of April, 1949.

SEVERNOATLANTSKA    
POGODBA
Pogodbenice te pogodbe ponovno potrjujejo svoje zaupanje v cilje in načela Ustanovne listine Združenih narodov ter svojo željo, da bi z vsemi narodi in vladami živele v miru.
Odločene so varovati svobodo, skupno dediščino in civilizacijo svojih narodov, temelječe na načelih demokracije, osebne svobode in vladavine prava.
Prizadevajo si za spodbujanje stabilnosti in blaginje na severnoatlantskem območju.
Odločene so združiti svoja prizadevanja za kolektivno obrambo ter ohranitev miru in varnosti.
Zaradi tega soglašajo s to Severnoatlantsko pogodbo:

1. člen

Pogodbenice se zavezujejo, da vse mednarodne spore, v katere bi bile lahko vpletene, rešujejo miroljubno, kot določa Ustanovna listina Združenih narodov, tako da mednarodni mir, varnost in pravičnost niso ogroženi, in da se v svojih mednarodnih odnosih vzdržijo grožnje s silo ali uporabe sile na način, ki ni v skladu s cilji Združenih narodov.

2. člen

Pogodbenice bodo s krepitvijo svojih svobodnih institucij, doseganjem boljšega razumevanja načel, na katerih temeljijo te institucije, in s spodbujanjem razmer, ki omogočajo stabilnost in blaginjo, prispevale k nadaljnjemu razvoju miroljubnih in prijateljskih mednarodnih odnosov. V svojih mednarodnih gospodarskih politikah si bodo prizadevale za odpravo sporov in bodo spodbujale gospodarsko sodelovanje med posameznimi ali vsemi pogodbenicami.

3. člen

Za učinkovitejše doseganje ciljev te pogodbe bodo pogodbenice z nenehno in učinkovito samopomočjo ter vzajemno pomočjo vsaka zase in skupaj vzdrževale in razvijale svojo individualno in kolektivno sposobnost upreti se oboroženemu napadu.

4. člen

Pogodbenice se bodo med seboj posvetovale, kadar koli bo po mnenju katere od njih ogrožena ozemeljska celovitost, politična neodvisnost ali varnost katere koli pogodbenice.

5. člen

Pogodbenice soglašajo, da se oborožen napad na eno ali več pogodbenic v Evropi ali Severni Ameriki šteje za napad na vse pogodbenice; in zaradi tega soglašajo, da bo v primeru takega oboroženega napada vsaka od njih ob uresničevanju pravice do individualne ali kolektivne samoobrambe, ki jo priznava 51. člen Ustanovne listine Združenih narodov, pomagala tako napadeni pogodbenici ali pogodbenicam s takojšnjim individualnim in z drugimi pogodbenicami dogovorjenim ukrepanjem, ki se ji zdi potrebno, vključno z uporabo oborožene sile, da se ponovno vzpostavi in ohranja varnost severnoatlantskega območja.
Vsak tak oborožen napad in vsi posledično sprejeti ukrepi se takoj sporočijo Varnostnemu svetu. Taki ukrepi prenehajo, ko Varnostni svet ukrene, kar je potrebno za ponovno vzpostavitev in ohranjanje mednarodnega miru in varnosti.

6. člen

Za namen 5. člena se šteje, da oborožen napad na eno ali več pogodbenic vključuje oborožen napad na ozemlje katere koli pogodbenice v Evropi ali Severni Ameriki, na departmaje Francije v Alžiriji, na zasedbene sile katere koli države pogodbenice v Evropi, na otoke pod jurisdikcijo katere koli pogodbenice na severnoatlantskem območju severno od rakovega povratnika ali na plovila ali zrakoplove katere koli pogodbenice.

7. člen

Ta pogodba ne vpliva na pravice in obveznosti pogodbenic, ki so članice Združenih narodov, izhajajoče iz Ustanovne listine, in se ne razlaga, kot da kakor koli vpliva nanje ali na primarno odgovornost Varnostnega sveta za ohranjanje mednarodnega miru in varnosti.

8. člen

Vsaka pogodbenica izjavlja, da nobena mednarodna obveznost, ki zdaj velja med njo in katero koli drugo pogodbenico ali tretjo državo, ni v nasprotju z določbami te pogodbe, in se zavezuje, da ne bo prevzela nobene mednarodne obveznosti, ki je v nasprotju s to pogodbo.

9. člen

Pogodbenice s to pogodbo ustanovijo svet, v katerem je zastopana vsaka od njih, da bo obravnaval zadeve v zvezi z izvajanjem te pogodbe. Svet je organiziran tako, da se lahko kadar koli takoj sestane. Svet ustanovi potrebne pomožne organe; predvsem takoj ustanovi obrambni odbor, ki priporoči ukrepe za izvajanje 3. in 5. člena.

10. člen

Pogodbenice lahko s soglasnim dogovorom povabijo katero koli drugo evropsko državo, ki je sposobna podpreti načela te pogodbe in prispevati k varnosti severnoatlantskega območja, da pristopi k tej pogodbi. Tako povabljena država lahko postane pogodbenica te pogodbe z deponiranjem svoje listine o pristopu pri Vladi Združenih držav Amerike. Vlada Združenih držav Amerike bo vsako od pogodbenic obvestila o deponiranju vsake take listine o pristopu.

11. člen

Pogodbenice to pogodbo ratificirajo in njene določbe izvajajo v skladu s svojimi notranjepravnimi postopki. Listine o ratifikaciji se čim prej deponirajo pri Vladi Združenih držav Amerike, ki bo vse druge podpisnice uradno obvestila o vsakem deponiranju. Pogodba začne med državami, ki so jo ratificirale, veljati takoj po deponiranju listin o ratifikaciji večine podpisnic, vključno z listinami o ratifikaciji Belgije, Francije, Kanade, Luksemburga, Nizozemske, Združenega kraljestva in Združenih držav, za druge države pa začne veljati na dan deponiranja njihovih listin o ratifikaciji.

12. člen

Po desetih letih veljavnosti te pogodbe ali kadar koli pozneje se pogodbenice, če katera od njih to zahteva, skupaj posvetujejo z namenom, da jo pregledajo in pri tem upoštevajo dejavnike, ki takrat vplivajo na mir in varnost na severnoatlantskem območju, vključno z razvojem dogovorov na svetovni in regionalni ravni po Ustanovni listini Združenih narodov za ohranjanje mednarodnega miru in varnosti.

13. člen

Po dvajsetih letih veljavnosti te pogodbe lahko katera koli pogodbenica preneha biti pogodbenica eno leto po tem, ko je obvestilo o odpovedi poslala Vladi Združenih držav Amerike, ki bo vlade drugih pogodbenic obvestila o deponiranju vsakega obvestila o odpovedi.

14. člen

Ta pogodba, katere angleško in francosko besedilo sta enako verodostojni, se hrani v arhivu Vlade Združenih držav Amerike. Ta vlada bo vladam drugih podpisnic poslala pravilno overjene izvode.
V potrditev tega so podpisani pooblaščenci podpisali to pogodbo.

P R O T O C O L    
TO THE NORTH ATLANTIC TREATY     
ON THE ACCESSION OF     
GREECE AND TURKEY

The Parties to the North Atlantic Treaty, signed at Washington on 4th April, 1949,
    Being satisfied that the security of the North Atlantic area will be enhanced by the accession of the Kingdom of Greece and the Republic of Turkey to that Treaty,

Agree as follows:—

ARTICLE I

Upon the entry into force of this Protocol, the Government of the United States of America shall, on behalf of all the Parties, communicate to the Government of the Kingdom of Greece and the Government of the Republic of Turkey an invitation to accede to the North Atlantic Treaty, as it may be modified by Article II of the present Protocol. Thereafter the Kingdom of Greece and the Republic of Turkey shall each become a Party on the date when it deposits its instrument of accession with the Government of the United States of America in accordance with Article 10 of the Treaty.

ARTICLE II

If the Republic of Turkey becomes a Party to the North Atlantic Treaty, Article 6 of the Treaty shall, as from the date of the deposit by the Government of the Republic of Turkey of its instrument of accession with the Government of the United States of America, be modified to read as follows: —

"For the purpose of Article 5, an armed attack on one or more of the Parties is deemed to include an armed attack—

(i) on the territory of any of the Parties in Europe or North America, on the Algerian Departments of France, on the territory of Turkey or on the islands under the jurisdiction of any of the Parties in the North Atlantic area north of the Tropic of Cancer;
    (ii) on the forces, vessels or aircraft of any of the Parties, when in or over these territories or any other area in Europe in which occupation forces of any of the Parties were stationed on the date when the Treaty entered into force or the Mediterranean Sea or the North Atlantic area north of the Tropic of Cancer."

ARTICLE III

The present Protocol shall enter into force when each of the Parties to the North Atlantic Treaty has notified the Government of the United States of America of its acceptance thereof. The Government of the United States of America shall inform all the Parties to the North Atlantic Treaty of the date of the receipt of each such notification and of the date of the entry into force of the present Protocol.

ARTICLE IV

The present Protocol, of which the English and French texts are equally authentic, shall be deposited in the Archives of the Government of the United States of America. Duly certified copies thereof shall be transmitted by that Government to the Governments of all the Parties to the North Atlantic Treaty.
     
    In witness whereof, the undersigned plenipotentiaries have signed the present Protocol.

P R O T O K O L    
O PRISTOPU     
GRČIJE IN TURČIJE     
K SEVERNOATLANTSKI POGODBI
Pogodbenice Severnoatlantske pogodbe, podpisane 4. aprila 1949 v Washingtonu, se,
zadovoljne, da se bo varnost severnoatlantskega območja povečala s pristopom Kraljevine Grčije in Republike Turčije k tej pogodbi,
sporazumejo o naslednjem:

I. ČLEN

Ob začetku veljavnosti tega protokola Vlada Združenih držav Amerike v imenu vseh pogodbenic Vladi Kraljevine Grčije in Vladi Republike Turčije pošlje vabilo za pristop k Severnoatlantski pogodbi, kot se lahko spremeni z 2. členom tega protokola. S tem Kraljevina Grčija in Republika Turčija postaneta pogodbenici z dnem, ko v skladu z 10. členom pogodbe deponirata svoji listini o pristopu pri Vladi Združenih držav Amerike.

II. ČLEN

Če Republika Turčija postane pogodbenica Severnoatlantske pogodbe, se 6. člen pogodbe z dnem, ko Vlada Republike Turčije deponira svojo listino o pristopu pri Vladi Združenih držav Amerike spremeni, kot sledi:
"Za namene 5. člena se šteje, da oboroženi napad na eno ali več pogodbenic vključuje oboroženi napad:

(i)

na ozemlje katere koli pogodbenice v Evropi ali Severni Ameriki, na departmaje Francije v Alžiriji, na ozemlje Turčije ali na otoke pod jurisdikcijo katere koli pogodbenice na severnoatlantskem območju severno od rakovega povratnika;

(ii)

na sile, plovila ali zrakoplove katere koli pogodbenice, ko so na teh ozemljih ali na katerem koli drugem območju v Evropi, na katerem so bile nameščene zasedbene sile katere koli pogodbenice na dan, ko je začela pogodba veljati, ali v Sredozemskem morju ali na severnoatlantskem območju severno od rakovega povratnika ali nad temi ozemlji ali območji."

III. ČLEN

Ta protokol začne veljati, ko vsaka pogodbenica Severnoatlantske pogodbe uradno obvesti Vlado Združenih držav Amerike, da ga je sprejela. Vlada Združenih držav Amerike obvesti vse pogodbenice Severnoatlantske pogodbe o datumu prejema vsakega takega uradnega obvestila in datumu začetka veljavnosti tega protokola.

IV. ČLEN

Ta protokol, katerega angleško in francosko besedilo sta enako verodostojni, se deponira v arhivu Vlade Združenih držav Amerike. Ta vlada pošlje pravilno overjene kopije protokola vladam vseh pogodbenic Severnoatlantske pogodbe.
V potrditev tega so podpisani pooblaščenci podpisali ta protokol.
Na voljo za podpis v Londonu 17. oktobra 1951.
P R O T O C O L    
TO THE NORTH ATLANTIC TREATY     
ON THE ACCESSION OF     
THE FEDERAL REPUBLIC OF GERMANY

The Parties to the North Atlantic Treaty signed at Washington on 4th April, 1949,
    Being satisfied that the security of the North Atlantic area will be enhanced by the accession of the Federal Republic of Germany to that Treaty, and
    Having noted that the Federal Republic of Germany has by a declaration dated 3rd October, 1954, accepted the obligations set forth in Article 2 of the Charter of the United Nations and has undertaken upon its accession to the North Atlantic Treaty to refrain from any action inconsistent with the strictly defensive character of that Treaty, and
    Having further noted that all member governments have associated themselves with the declaration also made on 3rd October, 1954, by the Governments of the United States of America, the United Kingdom of Great Britain and Northern Ireland and the French Republic in connection with the afore-said declaration of the Federal Republic of Germany,

Agree as follows:

Article I

Upon the entry into force of the present Protocol, the Government of the United States of America shall on behalf of all the Parties communicate to the Government of the Federal Republic of Germany an invitation to accede to the North Atlantic Treaty. Thereafter the Federal Republic of Germany shall become a Party to that Treaty on the date when it deposits its instruments of accession with the Government of the United States of America in accordance with Article 10 of that Treaty.

Article II

The present Protocol shall enter into force, when (a) each of the Parties to the North Atlantic Treaty has notified to the Government of the United States of America its acceptance thereof, (b) all instruments of ratification of the Protocol Modifying and Completing the Brussels Treaty have been deposited with the Belgian Government, and (c) all instruments of ratification or approval of the Convention on the Presence of Foreign Forces in the Federal Republic of Germany have been deposited with the Government of the Federal Republic of Germany. The Government of the United States of America shall inform the other Parties to the North Atlantic Treaty of the date of the receipt of each notification of acceptance of the present Protocol and of the date of the entry into force of the present Protocol.

Article III

The present Protocol, of which the English and French texts are equally authentic, shall be deposited in the archives of the Government of the United States of America. Duly certified copies thereof shall be transmitted by that Government to the Governments of the other Parties to the North Atlantic Treaty.
     
    In witness whereof, the undersigned Representatives, duly authorised thereto by their respective Governments, have signed the present Protocol.
     
    Signed at Paris the twenty-third day of October nineteen hundred and fifty four.
