Excellency,
I would like to inform you that the Council of the European Union has decided, in its meeting of 6 and 7 December 2001, to extend Europol’s mandate to deal also with those serious forms of international crime listed in the Annex to the Europol Convention. The extension of the mandate will take effect as of 1 January 2002.
In accordance with Article 3(3) of the Co-operation Agreement between the Republic of Slovenia and Europol I would like to suggest that this agreement be extended to include these new areas of crime. Europol is prepared to extend the Agreement to cover these areas as of 1 January 2002.
I would be grateful if you could let me know whether this proposal meets with your approval. For your information I attach a list of the additional forms of crime with which Europol has been instructed to deal as from the beginning of this year.
Let me conclude by expressing my hope that the extension of Europol’s mandate will make the co-operation between the Republic of Slovenia and Europol even more fruitful.

List of other serious forms of crime
In addition to the forms of crime already covered by the Co-operation Agreement (see below), Europol proposes the addition of the following forms of serious international crime:
Crimes against life, limb or personal freedom:
– murder, grievous bodily injury;
– illicit trade in human organs and tissue;
– kidnapping, illegal restraint and hostage-taking;
– racism and xenophobia.
Crimes against property or public goods including fraud(*1):
– organised robbery;
– illicit trafficking in cultural goods, including antiquities and works of art;
– swindling and fraud;
– racketeering and extortion;
– counterfeiting and product piracy;
– forgery of administrative documents and trafficking therein;
– computer crime;
– corruption.
Illegal trading and harm to the environment:
– illicit trafficking in arms, ammunition and explosives;
– illicit trafficking in endangered animal species;
– illicit trafficking in endangered plant species and varieties;
– environmental crime;
– illicit trafficking in hormonal substances and other growth promoters.
In addition, in accordance with Article 2 (2) of the Europol Convention, the act of instructing Europol to deal with one of the forms of crime listed above implies competency to deal with associated money-laundering activities and other related criminal offences.
(*1) The Council declared that the instruction of Europol to deal with ‘’fraud” as one of the forms of crime referred to in the Annex to the Europol Convention confers, as far as tax fraud and customs fraud is concerned, competences to Europol only in the field of improvement of the effectiveness and cooperation of the competent authorities of the Member States responsible for the functioning of the criminal law enforcement system and not their authorities responsible for ensuring the levying of taxes and customs duties.

Dear Sir,
I refer to the Agreement between the Republic of Slovenia and the European Police Office, done at Ljubljana on 1 October 2001, and have the honour to notify you on behalf of the Government of the Republic of Slovenia that the Republic of Slovenia agrees to extend the applicability of the Agreement in relation to the new Europol’s mandate to deal also with those serious forms of international crime, listed in the Annex to the Agreement. The applicability of the Agreement shall extend to the new mandate as from the date on which Europol receives the written acceptance of the proposal by the Republic of Slovenia. Therefore I would appreciate your confirmation of this letter.
However the extension of the Agreement in relation to the new Europol’s mandate to deal also with those serious forms of international crime listed in the Annex to the Agreement can enter into force as from the date the Republic of Slovenia will notify Europol in writing through diplomatic channels that its internal legal requirements have been complied with.
