POVZETEK
Prispevek preučuje (ne)uveljavitev konvencij MOD št. 148 in 155 v brazilskem pravnem sistemu
ob upoštevanju tega, da je Brazilija ustrezno ratificirala oba mednarodna instrumenta.
Stališče Vrhovnega sodišča je, da ni mogoče kumulirati dodatkov za nezdravo in za nevarno oziroma tvegano delo, kar naj ne bi bilo v nasprotju z ratificiranima konvencijama, saj ti neposredno ne zavezujeta delodajalcev. Članek zagovarja stališče, da bi zaradi zagotavljanja skladnosti s konvencijama v brazilskem domačem pravu morala biti zagotovljena možnost kumuliranja obeh dodatkov. Gre za teoretično bibliografsko raziskavo deduktivne narave s ciljem preučiti vsebino obeh konvencij ter stališča pravne doktrine in sodne prakse o tej temi.
SUMMARY
This study aims to analyse the (un-)enforceability of 148 and 155 ILO agreements within the scope of the domestic law, considering that both international instruments have been duly
ratified by Brazil. The position hitherto defended by the Superior Labour Court is due to the impossibility of cumulating unhealthy and dangerous/dangerous/hazardous work additional remuneration, confirming the understanding of the non-contradiction of the ratification of these Conventions in the sphere of the national law. This is a theoretical-bibliographical research, with a deductive nature, with a view to address the content of these Conventions and, above all, the understanding and positioning of doctrine and jurisprudence on the subject.
