o ratifikaciji Memoranduma o soglasju med Vlado Republike Slovenije in Vlado Republike Filipini o sodelovanju na področju dela

1. člen

Ratificira se Memorandum o soglasju med Vlado Republike Slovenije in Vlado Republike Filipini o sodelovanju na področju dela, podpisan v Manili 11. marca 2025.

2. člen

Memorandum se v izvirniku v angleškem jeziku in v prevodu v slovenskem jeziku glasi:

MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES ON LABOR COOPERATION

The Government of the Republic of Slovenia, represented by its Ministry of Labour, Family, Social Affairs and Equal Opportunities, and the Government of the Republic of the Philippines, represented by its Department of Migrant Workers, hereinafter referred to as the “First Participant”, herein referred to as the “Second Participant”, and collectively referred to as “Participants”,
WHEREAS, both Governments of the Participants desire to strengthen the existing friendly bilateral relations between the two countries;
WHEREAS, both Participants are aware of the importance of knowledge transfer and the sharing of expertise between them through meaningful cooperation in the field of healthcare, labor and manpower development;
WHEREAS, the First Participant wishes to assist the Second Participant in addressing its labor shortage; and
WHEREAS, both Participants mutually commit to observe fair, ethical and sustainable recruitment practices in the employment of workers, anchored on the laws and regulations of both Participants;
WHEREFORE, the Participants have reached the following understanding:

SECTION 1
OBJECTIVES
This Memorandum of Understanding (hereinafter the MOU) aims to achieve the following purposes:
1. Facilitate a strong working relationship between the Participants in the field of labor and employment in accordance with respective laws, rules and regulations in both States;
2. Explore and identify other opportunities for mutually beneficial cooperation, enhance cultural and people-to-people exchanges, and achieve common goals toward development and prosperity;
3. Strengthen dialogue and cooperation between the Participants in the following areas of cooperation, as they relate to the recruitment and immigration of workers in the State of the First Participant.

SECTION 2
AREAS OF COOPERATION
The Governments of both Participants undertake to establish cooperation in the following areas:
1. Provision of necessary protection, welfare and social security to, and adoption of measures aimed at promoting the rights of, workers from the State of the First Participant who are interested in working in the State of the Second Participant; and facilitating their recruitment, with due regard to the national demand for similar work in the State of the First Participant;
2. Bilateral exchanges in the area of policy development, including but not limited to:
a. Sharing, learning, and understanding current trends in various professions;
b. Sharing best practices between governments and/or public and private institutions;
c. Professional and technical capacity-building initiatives such as the provision of scholarship grants, conduct of trainings and seminars, modernizing facilities in the State of the First Participant, faculty development, and the like;
d. Provision of support in the fight against emerging infectious diseases, and to mitigate their adverse effects to the economy;
e. Promotion of anti-illegal recruitment and anti-human trafficking activities;
f. Supporting programs that aid in the reintegration of workers who opt to return to the State of the First Participant after the expiration of their contracts;
g. Facilitating visa procedures for workers from the Republic of the Philippines; and
h. Other areas of policy development that both Participants may jointly decide upon;
3. Carrying out of a formal collaborative effort to support the certification, recognition and matching of skills and qualifications of workers in the State of the First Participant in relation to education and training;
4. Promotion of sound, ethical, and equitable recruitment and employment practices and ensuring that the employers, recruitment agencies or other such brokers, or any other entity, do not charge or receive, directly or indirectly, any payment for recruitment fees against workers from the State of the First Participant;
5. Drawing up of an agenda to improve the education and training of workers from the State of the First Participant, including the protection of their rights and the promotion of their welfare;
6. Enforcement of legal measures against employers and others entities or individuals for any violation of applicable laws, rules and regulations, including those relating to trafficking in persons and modern-day slavery;
7. Provision of access to all necessary measures that extend legal assistance and social protection to workers in accordance with the laws and regulations in both States;
8. When applicable, provision of adequate financial assistance to support workers in the State of the First Participant whilst undergoing assessment, education, equivalence training, and licensing in the State of the Second Participant; and
9. Collaboration to resolve expeditiously any and all issues arising from the administration of this MOU including readmission of persons.
Both Participants shall encourage their implementing authorities to coordinate in the above-mentioned activities in accordance with the laws, rules and regulations in force in each State.
This MOU shall not apply to professionals in the healthcare-related sectors.

SECTION 3
AGREEMENT ON EMPLOYMENT
1. With the purpose of regulating the employment of workers from the State of the First Participant in the State of the Second Participant, the Participants agree that they will strive to conclude an employment agreement.
2. The Participants shall strive that the agreement, referred to in the previous paragraph, regulates the obligation of the employer from the Second Participant to pay for the airfare of the worker from the First Participant in the following cases: a) departure from his/her home residence in the State of the First Participant to his/her workplace in the State of the Second Participant; b) upon the expiration of the employment contract; c) in cases of the cancellation of the contract by the employer; d) when the worker quits his/her job because of the employer's violation of the employment contract; e) in cases of force majeure; and f) repatriation of human remains of the worker and his/her belongings.
3. The Participants agree that they will strive to address the employment of medical doctors and nurses with acquired higher education qualifications from the State of the First Participant in the State of the Second Participant at a later stage.

SECTION 4
EMPLOYMENT CONTRACT
The workers shall be employed under an employment contract, in accordance with applicable laws, rules and regulations, which shall be binding and mandatory between the employer and the worker.

SECTION 5
JOINT COMMITTEE
A Joint Committee will be formed consisting of the representatives of the Participants, which will fulfill the following:
1. Develop guidelines for the implementation of this MOU;
2. Resolve disputes arising from the implementation and the interpretation of the provisions of this MOU;
3. Propose possible amendments in the MOU;
4. Conduct regular annual meetings in the Republic of the Philippines and in the Republic of Slovenia, alternately; and 5. Decide the date and place of the meetings through diplomatic channels.

SECTION 6
AGREEMENT ON SOCIAL SECURITY
With the purpose of ensuring the rights to social security of workers, in particular from the State of the First Participant, both Participants agree that they will strive to conclude a social security agreement.

SECTION 7
SETTLEMENT OF DIFFERENCES
Any differences between the Participants arising out of the interpretation or implementation of this MOU shall be settled by consultations or negotiations at the level of the Joint Committee. Unresolved issues may be raised through diplomatic channels.

SECTION 8
EFFECTIVITY
This MOU shall become effective on the date of later notification by the Participants, through diplomatic channels, indicating that the domestic requirements for its entry into effect have been complied with.

SECTION 9
VALIDITY, DURATION, AND TERMINATION
1. This MOU shall remain valid for three (3) years and shall be automatically extended for successive three (3) year periods unless one Participant officially notifies the other Participant of its desire to suspend or terminate this MOU, with the written notification submitted at least three (3) months prior to the intended date of suspension or termination, through diplomatic channels.
2. Unless otherwise agreed upon by the Participants, the suspension or termination of this MOU shall not prejudice the completion and continuation of existing and valid arrangements initiated under this MOU.
3. The Joint Committee may, at least three (3) months prior to the expiration of any three (3) year period, reach a decision, that the MOU is to be terminated. In such a case, the Participants shall mutually confirm the date of termination of this MOU through diplomatic channels.

SECTION 10
AMENDMENT AND REVISION
Any amendment or revision to the text of this MOU shall be done by mutual written consent of the Participants, through diplomatic channels. Such amendment or revision shall come into effect in accordance with Section 8 hereof.
IN WITNESS WHEREOF, the undersigned being duly authorized by their respective Governments, have signed this MOU.

MEMORANDUM O SOGLASJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE FILIPINI O SODELOVANJU NA PODROČJU DELA

Vlada Republike Filipini, ki jo zastopa Ministrstvo za delavce migrante, v nadaljnjem besedilu: prvi udeleženec, in Vlada Republike Slovenije, ki jo zastopa Ministrstvo za delo, družino, socialne zadeve in enake možnosti, v nadaljnjem besedilu: drugi udeleženec, skupaj v nadaljnjem besedilu: udeleženca,
KER želita vladi okrepiti obstoječe prijateljske dvostranske odnose med državama;
KER se udeleženca zavedata pomena medsebojnega prenosa znanja in izmenjave strokovnega znanja s poglobljenim sodelovanjem na področju zdravstvenega varstva, dela in razvoja človeških virov;
KER želi prvi udeleženec pomagati drugemu udeležencu pri odpravljanju pomanjkanja delovne sile;
KER se udeleženca vzajemno zavezujeta, da bosta spoštovala poštene, etične in trajnostne prakse zaposlovanja delavcev, ki temeljijo na zakonih in predpisih obeh udeležencev;
ZATO sta se udeleženca dogovorila:

1. RAZDELEK

CILJI

Namen tega memoranduma o soglasju (v nadaljnjem besedilu: memorandum) je doseči naslednje cilje:

1.

omogočiti trden delovni odnos med udeležencema na področju dela in zaposlovanja v skladu z zakoni, pravili in predpisi obeh držav;

2.

raziskati in opredeliti druge priložnosti za obojestransko koristno sodelovanje, okrepiti kulturno izmenjavo in medčloveške stike ter doseči skupne cilje za razvoj in blaginjo;

3.

okrepiti dialog in sodelovanje med udeležencema na področjih, ki se nanašajo na zaposlovanje in priseljevanje delavcev iz države prvega udeleženca.

2. RAZDELEK

PODROČJA SODELOVANJA

Vladi se zavezujeta, da bosta vzpostavili sodelovanje na naslednjih področjih:

1.

zagotavljanje potrebne zaščite, blaginje in socialne varnosti ter sprejemanje ukrepov za spodbujanje pravic delavcev v državi prvega udeleženca, ki želijo delati v državi drugega udeleženca, ter olajševanje njihovega zaposlovanja ob ustreznem upoštevanju domačega povpraševanja po podobnem delu v državi prvega udeleženca;

2.

dvostranske izmenjave na področju oblikovanja politik, kar med drugim vključuje:

a.

izmenjavo, učenje in razumevanje trenutnih trendov v različnih poklicih;

b.

izmenjavo dobrih praks med vladama in/ali javnimi in zasebnimi institucijami;

c.

pobude za krepitev strokovnih in tehničnih zmogljivosti, kot so zagotavljanje štipendij, izvajanje usposabljanj in seminarjev, posodabljanje namenske infrastrukture v državi prvega udeleženca, razvoj zmožnosti, in podobno;

d.

zagotavljanje podpore v boju proti novim nalezljivim boleznim in za ublažitev njihovih negativnih posledic za gospodarstvo;

e.

spodbujanje dejavnosti za preprečevanje nezakonitega zaposlovanja in trgovine z ljudmi;

f.

podpora programom za pomoč pri ponovnem vključevanju delavcev, ki se po izteku pogodbe odločijo za vrnitev v državo prvega udeleženca;
