O RATIFIKACIJI SKLEPOV ŠT. 2 DO 8 SKUPNEGA ODBORA EFTA - SLOVENIJA

1. člen

Ratificirajo se sklepi št. 2 do 8 Skupnega odbora EFTA - Slovenija, sprejeti na četrtem zasedanju odbora 27. maja 1999 v Ženevi.

2. člen

Sklepi se v izvirniku v angleškem jeziku in v prevodu v slovenskem jeziku glasijo:

RULES OF PROCEDURE OF    
THE JOINT EFTA-SLOVENIA COMMITTEE

THE JOINT COMMITTEE,
    Having regard to paragraph 4 of Article 28 of the Agreement between the EFTA States and the Republic of Slovenia, adopts the following rules of procedure:

Article 1

The meetings of the Joint Committee shall be convened by the Secretary-General of the European Free Trade Association (EFTA) after consultations with the States Parties to the Agreement.

Article 2

A Provisional Agenda for each meeting shall be prepared by the Secretary-General of EFTA after consultation with the States Parties to the Agreement and sent to them, as a general rule, 14 days before the meeting. Any State Party to the Agreement may propose the inclusion of any item related to the agreement in the Agenda of the Joint Committee meeting.

Article 3

The Joint Committee shall meet whenever necessary but normally once a year.

Article 4

Unless the Joint Committee decides otherwise, the meetings shall not be public.

Article 5

Signatory States of the Agreement or States acceding to it which have not yet deposited their instruments of ratification, acceptance or accession or for whom the Agreement has not entered into force, may attend all meetings of the Joint Committee as observers without the right to take part in decisions.

Article 6

The Secretary-General of EFTA or his representative may attend all meetings of the Joint Committee.

Article 7

Meetings of the Joint Committee shall be chaired in turn by a representative of an EFTA State and by a representative of Slovenia.

Article 8

The working language of the Joint Committee is English.

Article 9

A summary record of the deliberations and of the decisions taken at each meeting shall be made and circulated to all representatives for approval in writing; it shall be approved at the latest eight weeks after the meeting. Decisions of the Joint Committee shall bear a number and a title referring to their subject matter.

Article 10

Where a matter is urgent and a meeting cannot be held, decisions of the Joint Committee may be taken by written procedure, if so agreed by the States Parties to the Agreement. In such cases the proposed draft decisions shall be circulated by the Secretary-General of EFTA to the States Parties to the Agreement.

Article 11

The Secretariat services for the Joint Committee and its sub-committees and working parties shall be provided by the EFTA Secretariat.

Article 12

Notifications to the Joint Committee in accordance with the provisions of the Agreement shall be made through the EFTA Secretariat.

DECISION OF THE JOINT EFTA-SLOVENIA COMMITTEE

No. 3 of 1999

ESTABLISHMENT OF A SUB-COMMITTEE ON CUSTOMS AND ORIGIN MATTERS

THE JOINT COMMITTEE,
    Having regard to paragraph 5 of Article 28 of the Agreement,
    Noting the minutes agreed on signing the Free Trade Agreement between the EFTA States and Slovenia, done at Bergen on 13 June 1995,
    DECIDES:
    1. A Sub-Committee on customs and origin matters is hereby established.
    2. The functions of the Sub-Committee shall be to exchange information, review developments and assist the Joint Committee regarding:
    a) rules of origin and methods of administrative co-operation laid down in Protocol B to the Agreement,
    b) other customs matters as defined in paragraph 2 of Article 3 of the Agreement,
    c) other customs matters referred to it by the Joint Committee.
    The Sub-Committee may make recommendations to the Joint Committee on subjects related to its function.
    3. The Sub-Committee shall report to the Joint Committee.
    4. Each State, Party to the Agreement may be represented in the Sub-Committee.
    5. Meetings of the Sub-Committee shall be chaired by a representative of an EFTA State or by a representative of Slovenia for an agreed period of time.
    6. The Sub-Committee shall meet as often as required. It shall be convened by the Joint Committee, by the Chairman of the Sub-Committee on his own initiative or upon request by one of the States, Parties to the Agreement.
    7. A provisional Agenda for each meeting shall be prepared by the EFTA Secretariat in consultation with the Chairman and sent to the members, as a general rule, 14 days before the meeting.

REVISED ANNEX I

(CONCERNING THE NON-APPLICATION OF THE FREE TRADE AGREEMENT ON CERTAIN PRODUCTS)

THE JOINT COMMITTEE,
    Having regard to the HS revision which took effect on 1 January 1996,
    Having regard to Article 32 of the Agreement, empowering the Joint Committee to amend the Annexes of the Agreement,
    DECIDES:
    1. The following two items shall be deleted from Annex I:
    – 53.01 (flax, flax tow and waste)
    – 53.02 (true hemp, tow and waste of true hemp)
    2. Annex I shall be replaced with the following wording:

REVISED ANNEX III:

(CUSTOMS DUTIES ON IMPORTS AND CHARGES HAVING EQUIVALENT EFFECT)

THE JOINT COMMITTEE,
    Noting that Norway eliminated the remaining duties on textiles and clothing products listed in Table to Annex III on 1 January 1999,
    Considering that Liechtenstein and Switzerland have agreed to delete paragraph 2 of Annex III,
    Having regard to Article 32 of the Agreement, empowering the Joint Committee to amend the Annexes of the Agreement,
    DECIDES:
    1. The content of Annex III shall be deleted.
    2. The revised Annex shall enter into force on 1 July 1999.
    3. The Secretary-General of the European Free Trade Association shall deposit the text of this Decision with the Depositary.

DECISION OF THE JOINT EFTA-SLOVENIA COMMITTEE

No. 6 of 1999

REVISED PROTOCOL C:

(CUSTOMS DUTIES OF A FISCAL NATURE)

THE JOINT COMMITTEE,
    Noting that Liechtenstein and Switzerland have replaced all remaining duties of a fiscal nature by internal taxes,
    Having regard to Article 32 of the Agreement, empowering the Joint Committee to amend the Annexes and Protocols of the Agreement,
    DECIDES:
    1. The content of Protocol C shall be deleted.
    2. The revised Protocol shall enter into force on 1 July 1999.
    3. The Secretary-General of the European Free Trade Association shall deposit the text of this Decision with the Depositary.

REVISED ANNEX V :

(CONCERNING CUSTOMS DUTIES ON EXPORTS AND CHARGES HAVING EQUIVALENT EFFECT)

THE JOINT COMMITTEE,
    Noting that Slovenia has abolished all customs duties on exports and charges having equivalent effect,
    Having regard to Article 32 of the Agreement, empowering the Joint Committee to amend the Annexes of the Agreement,
    DECIDES:
    1. The content of Annex V shall be deleted.
    2. The revised Annex shall enter into force on 1 July 1999.
    3. The Secretary-General of the European Free Trade Association shall deposit the text of this Decision with the Depositary.

DECISION OF THE JOINT EFTA-SLOVENIA COMMITTEE

No. 8 of 1999

REVISED ANNEX VI:

(CONCERNING IMPORT AND EXPORT RESTRICTIONS)

THE JOINT COMMITTEE,
    Noting that Iceland has abolished the quantitative restrictions on imports in relation to brooms and brushes referred to in Table A to Annex VI,
    Further, noting that Liechtenstein and Switzerland have abolished the application of export restrictions on ferrous waste and scrap referred to in Table B to Annex VI,
    Having regard to Article 32 of the Agreement, empowering the Joint Committee to amend the Annexes of the Agreement,
    DECIDES:
    1. The content of Annex VI shall be deleted.
    2. The revised Annex shall enter into force on 1 July 1999.
    3. The Secretary-General of the European Free Trade Association shall deposit the text of this Decision with the Depositary.

SKLEP SKUPNEGA ODBORA SLOVENIJA – EFTA

P O S L O V N I K
SKUPNEGA ODBORA SLOVENIJA – EFTA
SKUPNI ODBOR,
ob upoštevanju četrtega odstavka 28. člena Sporazuma med državami članicami EFTE in Republiko Slovenijo sprejme naslednji poslovnik:

1. člen

Sestanke Skupnega odbora sklicuje generalni sekretar Evropskega združenja za prosto trgovino (EFTA) po posvetovanju z državami podpisnicami sporazuma.

2. člen

Preliminarni dnevni red za vsak sestanek sestavi generalni sekretar EFTE po posvetovanju z državami podpisnicami sporazuma in jim ga praviloma pošlje 14 dni pred sestankom. Vsaka država podpisnica sporazuma lahko predlaga, da se na dnevni red sestanka Skupnega odbora vnese katerakoli točka, ki se nanaša na sporazum.

3. člen

Skupni odbor se sestaja po potrebi, običajno pa enkrat letno.

4. člen

Sestanki Skupnega odbora so zaprti za javnost, razen če odbor odloči drugače.

5. člen

Države podpisnice sporazuma in države v pristopu, ki še niso predložile svojih listin o ratifikaciji, sprejemu ali pristopu in za katere sporazum še ni začel veljati, se lahko udeležijo vseh sestankov skupnega odbora kot opazovalke, vendar nimajo pravice sodelovati pri odločanju.

6. člen

Generalni sekretar EFTE ali njegov predstavnik se lahko udeležita vseh sestankov Skupnega odbora.

7. člen

Sestanke Skupnega odbora vodita izmenoma predstavnik držav EFTE in predstavnik Slovenije.

8. člen

Delovni jezik Skupnega odbora je angleščina.

9. člen

O razpravi in odločitvah z vsakega sestanka se sestavi kratko poročilo in se pošlje vsem predstavnikom, da ga pisno potrdijo. Potrdijo ga najkasneje osem tednov po sestanku. Odločitve Skupnega odbora so označene s številko in z naslovom, ki povzema predmet razprave.

10. člen

Kadar je zadeva nujna, sestanka pa ni mogoče sklicati, Skupni odbor sprejme odločitve po pisnem postopku, če se države podpisnice sporazuma strinjajo s tem. V takem primeru generalni sekretar EFTE pošlje predlagane osnutke odločitev državam podpisnicam sporazuma.

11. člen

Tajniške storitve za Skupni odbor, njene pododbore in delovne skupine opravlja Sekretariat EFTE.
