Zakon o ratifikaciji Spremembe Kreditne pogodbe (Projekt slovenskih avtocest vzhod-zahod) med Republiko Slovenijo in Evropsko banko za obnovo in razvoj z dne 10. junija 1994 (MPAEB-A)

AMENDMENT dated 11. September 1998 (the “Amendment“) to the LOAN AGREEMENT, dated 10 June 1994, between the EUROPEAN BANK FOR RECONSTRUCTION AND DEVELOPMENT (the “Bank“) and Republic of Slovenia (the “ Borrower“).
    WHEREAS, the Bank and the Borrower entered into a Loan Agreement, dated 10 June 1994 (the “Loan Agreement“);
    NOW THEREFORE, the parties hereto hereby agree to amend the Loan Agreement as follows:
    1. Part A of Schedule 1 to the Loan Agreement is hereby deleted in its entirety and substituted with the following:

“Part A: Road Schemes

Construction, or upgrading and maintenance of Road Schemes including:
    (1) reconstruction/upgrading of the route between Pocehova and Lendava;
    (2) rehabilitation works on road sections as provided in Annex 1 to this Amendment subject to such modifications thereof as may be agreed between the Bank and the Government of the Borrower prior to conclusion of the relevant contracts;
    (3) widening of the road between Crnuce to Domzale; and
    (4) reconstruction of the major road M-3 crossing with the railway underpass at Ptuj.“
    2. Paragraph 1(a) of Schedule 3 of the Loan Agreement is hereby amended to read in its entirety as:

“Goods, works and services (excluding consultants’ services which are covered under paragraph (2) of this Schedule) shall be procured through open tendering, expect that contracts for goods and services for the introduction of road monitoring equipment under Part B of the Project described in Schedule 1, in an aggregate amount not exceeding the equivalent of USD 700,000 and not exceeding the equivalent of USD 400,000 per contract may be procured through shopping.“

3. This Amendment is limited as specified herein and shall not constitute a modification, acceptance or waiver of any other provision of the Loan Agreement or any other document.
    4. This Amendment shall be implemented provisionally from the date of its signature by the parties to it and shall enter into force on the date upon which the Bank notifies the Borrower on its acceptance of documentary evidence in form and substance satisfactory to the Bank that the execution of this Amendment by the Borrower has been duly authorised and ratified and that this Amendment is legally binding upon the Borrower in accordance with its terms.
    5. This Amendment shall be executed in three (3) counterparts, each of which shall be deemed an original, and all of which together constitute one and the same document.
    IN WITNESS WHEREOF, the parties hereto, acting through their duly authorized representatives, have caused this Amendment to be signed by correspondence as of the date first above written.
