POVZETEK
Avtor kot odvetnik podaja oceno vpliva sprememb Zakona o pravdnem postopku iz leta 2008. Kot pozitivne ocenjuje tiste novosti, ki koristijo strnjenosti in hitrosti postopka in krepijo kakovost sodnikove odločitve. Nekatere druge novosti, kot so zavrženje tožbe, če odvetnik ni predložil pooblastila, ali zavrženje njegove nepopolne vloge, so prestroge, nepotrebne in predvsem v škodo strank. Prekluzije prepozno navedenih dejstev in dokazov ni mogoče uveljavljati, če sodnik ne opravi svoje zakonske dolžnosti v okviru materialnega pravdnega varstva.
SUMMARY
The author presents the effects of the amendments to the Civil Procedure Act adopted in 2008 from the aspect of a practicing attorney. The novelties that support the concentration and the speedy conduct of the civil procedure and at the same time strengthen the quality of the judge's decision should be welcomed. Some other novelties, however, such as rejection of a claim if the power of attorney has not been submitted in writing or if an attorney’s written submission is in-complete, are too rigorous, unnecessary and harmful to the client's interest. Precluding the facts and evidence should only be possible after a judge has fulfilled his duty with regard to the substan-tive conduct of the proceedings.
