Na podlagi prve in tretje alinee petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 45/01) izdaja Vlada Republike Slovenije

O RATIFIKACIJI 23. IN 24. SPREMEMBE PARIŠKEGA MEMORANDUMA O SOGLASJU GLEDE NADZORA, KI GA OPRAVLJA INŠPEKCIJA ZA VARNOST PLOVBE

1. člen

Ratificirata se 23. in 24. sprememba Pariškega memoranduma o soglasju glede nadzora, ki ga opravlja inšpekcija za varnost plovbe, sprejeti 11. maja 2000 in 11. maja 2001 v Southamptonu.

2. člen

23. in 24. sprememba se v izvirniku v angleškem jeziku in v prevodu v slovenskem jeziku glasita:

Amendment to the Preamble of the Paris Memorandum of Understanding on Port State Control, as adopted and accepted by the Port State Control Committee at its 33rd meeting on 11 May 2000.

1. Insert in the Preamble of the Paris memorandum of Understanding on Port State Control, between “Greece” and “Ireland”:

    to the Paris memorandum of Understanding on Port State Control, as adopted on 11 May 2001
    I Amendment to the Paris memorandum of Understanding on Port State Control, as adopted by the Port State Control Committee at its     34th meeting on 11 May 2001.

    The existing text of Section 1, paragraph 1.3 is replaced by:
    1.3 Each Authority will achieve an annual total of inspections corresponding to 25% of the average number of individual foreign merchant ships, hereinafter referred to as ‘ships’, which entered the ports of its State during the three last calendar years for which statistics are available.

    A new paragraph 1.5 is added to Section 1:
    1.5 Each Authority, or any other body, as the case may be, will establish an appropriate procedure for pilot services and port authorities to immediately inform the competent Authority of the port State, whenever they learn in the course of their normal duties that there are deficiencies which may prejudice the safety of the ship, or which may pose a threat of harm to the marine environment.

    The existing text of Section 3, paragraph 3.7.3 is replaced by:
    3.7.3 Where the ground for a detention is the result of accidental damage suffered on the ship’s voyage to a port or during cargo operations, no detention order will be issued, provided that:
    .1 due account has been given to the requirements contained in Regulation I/11(c) of SOLAS 74 regarding notification to the flag State Administration, the nominated surveyor or the recognized organization responsible for issuing the relevant certificate;
    .2 prior to entering a port or immediately after a damage has occured, the master or shipowner has submitted to the port State control authority details on the circumstances of the accident and the damage suffered and information about the required notification of the flag State Administration;
    .3 appropriate remedial action, to the satisfaction of the Authority, is being taken by the ship, and
    .4 the Authority has ensured, having been notified of the completion of the remedial action, that deficiencies which were clearly hazardous to safety, health or the environment have been rectified.

    The existing text of Section 3, paragraph 3.9.3 is replaced by:
    3.9.3 Notwithstanding the provisions of 3.9.1, access to a specific port may be permitted by the relevant authority of that port State in the event of force majeure or overriding safety considerations, or to reduce or minimize the risk of pollution, provided that adequate measures to the satisfaction of the competent authority of such State have been implemented by the owner, the operator or the master of the ship to ensure safe entry.

II Amendment to Annex 1 of the Paris Memorandum of Understanding on Port State Control, as adopted by the Port State Control Committee at its 34th meeting on 11 May 2001.

    The existing text of Section 1, paragraph 1.1, sub-paragraph .1 is replaced by:
    .1 Ships which have been reported by pilots or port authorities in accordance with section 1.5 of the Memorandum;

    .6 Ships which have been suspended or withdrawn from their class for safety reasons in the course of the preceding 6 months.

    At the initial inspection the port State control officer will, as a minimum and to the extent applicable, examine the following documents:
    .1 International Tonnage Certificate (1969);
    .2 Passenger Ship Safety Certificate;
    .3 Cargo Ship Safety Construction Certificate;
    .4 Cargo Ship Safety Equipment Certificate;
    .5 Cargo Ship Safety Radio Certificate;
    .6 Exemption Certificate and any list of cargoes (as per SOLAS II- 2/53.1.3);
    .7 Cargo Ship Safety Certificate;
    .8 Document of Compliance (SOLAS 74, Regulation II-2/54)
    .9 Dangerous goods special list or manifest, or detailed stowage plan;
    .10 International Certificate of Fitness for the Carriage of Liquefied Gases
     in Bulk, or the Certificate of Fitness for the Carriage of Liquefied Gases in Bulk, whichever is appropriate;

    .12 International Oil Pollution Prevention Certificate;
    .13 International Pollution Prevention Certificate for the Carriage of Noxious Liquid Substances in Bulk;
    .14 International Load Line Certificate (1966);
    .15 International Load Line Exemption Certificate;
    .16 Oil Record Book, parts I and II;
    .17 Shipboard Oil Pollution Emergency Plan
    .18 Cargo Record Book;
    .19 Minimum Safe Manning Document;
    .20 Certificates issued in accordance with STCW Convention;
    .21 Medical certificates (see ILO Convention No. 73);

    .24 Certificates as to the ship’s hull strength and machinery installations issued by the classification society in question (only to be required if the ship maintains its class with a classification society);
    .25 Survey Report Files (in case of bulk carriers or oil tankers);
    .26 For ro-ro passenger ships, information on the A/A-max ratio;
    .27 Document of authorization for the carriage of grain;
    .28 Special Purpose Ship Safety Certificate;
    .29 High Speed Craft Safety Certificate and permit to Operate High Speed
     Craft;
    .30 Mobile Offshore Drilling Unit Safety Certificate;
    .31 For oil tankers, the record of oil discharge monitoring and control
     system for the last ballast voyage;
    .32 The muster list, fire control plan, and for passenger ships, a damage control plan, a decision-support system for the master (printed emergency plan);
    .33 Ship’s log book with respect to the records of tests and drills and the log for records of inspection and maintenance of lifesaving appliances and arrangements;
    .34 Reports of previous port State control inspections;
    .35 Cargo Securing Manual;
    .36 For passenger ships, List of operational limitations;
    .37 For passenger ships, a Plan for co-operation with SAR Services;
    .38 Bulk Carrier Booklet;
    .39 Loading/Unloading Plan for bulk carriers;
    .40 Garbage Management Plan;
    .41 Garbage Record Book;
    .42 Certificate of insurance or any other financial security in respect of civil liability for oil pollution damage.

    Insert at the end of Section 5, paragraph 5.2.2, the words “, as amended”.

    Replace in section 8, paragraph 8.4.2, item 10, the words “engine room” with the words “oily-water”.

Besedilo odstavka 1.3 razdelka 1 se nadomesti z:
1.3 Vse oblasti bodo dosegle skupno letno število pregledov, ki ustreza 25% povprečnega števila posameznih tujih trgovskih ladij, v nadaljnjem besedilu ladje, ki so vplule v pristanišča njihove države v zadnjih treh koledarskih letih, za katera so na razpolago statistični podatki.

Razdelku 1 se doda nov odstavek 1.5:
1.5 Vse oblasti oziroma kateri koli drug organ bo uvedel ustrezen postopek za pilotske službe in pristaniške oblasti, da bodo takoj obvestile pristojno oblast pristaniške države, kadar bodo med opravljanjem svojih običajnih dolžnosti ugotovile pomanjkljivosti, ki lahko ogrozijo varnost ladje ali škodujejo morskemu okolju.

Besedilo odstavka 3.7.3 razdelka 3 se nadomesti z:
3.7.3 Kadar je vzrok za zadržanje posledica naključne poškodbe, ki jo je ladja utrpela na svojem potovanju do pristanišča ali med postopki s tovorom, se nalog za zadržanje ne izda, če:
.1 so bile dovolj upoštevane zahteve, vsebovane v Predpisu I/11(c) SOLAS 74, glede uradnega obvestila upravi države, pod katere zastavo plove ladja, imenovanemu inšpektorju klasifikacijskega zavoda ali pooblaščeni organizaciji, odgovorni za izdajanje ustreznih spričeval;
.2 pred vplutjem v pristanišče ali takoj po nastanku škode poveljnik ali ladjar predloži inšpekciji za varnost plovbe podrobne podatke o okoliščinah, v katerih se je pripetila nesreča, ter o nastali škodi kot tudi podatke o zahtevanem uradnem obvestilu upravi države, pod katere zastavo plove ladja;
.3 ladja ustrezno ukrepa za odpravo pomanjkljivosti, s čimer zadovolji oblast, in
.4 oblast potrdi, potem ko je bila uradno obveščena o odpravi pomanjkljivosti, da so bile odpravljene pomanjkljivosti, ki so očitno ogrožale varnost, zdravje ali okolje.

Besedilo odstavka 3.9.3 razdelka 3 se nadomesti z:
3.9.3 Ne glede na določbe v 3.9.1 lahko pristojni organ pristaniške države dovoli vplutje ladje v določeno pristanišče zaradi višje sile ali zelo pomembnih varnostnih razlogov ali zmanjšanja ali minimiziranja nevarnosti onesnaženja, če lastnik, ladjar ali poveljnik ladje izvede ustrezne ukrepe za zagotovitev varnega vplutja, ki zadovoljijo pristojni organ te države.
