2. člen

Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi(1):

S P O R A Z U M <br /> med Vlado Republike Slovenije in Vlado Republike Indije o oprostitvi vizumske obveznosti za kratkoročno bivanje za imetnike diplomatskih potnih listov

Vlada Republike Slovenije in Vlada Republike Indije (v nadaljnjem besedilu: pogodbenici) sta se

v želji ohraniti načelo vzajemnosti in državljanom obeh pogodbenic, imetnikom diplomatskih potnih listov, omogočiti vstop in kratkoročno bivanje brez vizuma,

ob upoštevanju svojih notranjih predpisov in postopkov,

z namenom še naprej razvijati prijateljske odnose in krepiti tesne vezi med pogodbenicama

dogovorili:

1. člen

Namen in obseg

Državljani pogodbenic, imetniki veljavnega diplomatskega potnega lista, lahko v skladu z določbami tega sporazuma vstopijo na ozemlje druge pogodbenice, potujejo čezenj in bivajo tam brez vizuma (a) tri mesece na ozemlju Republike Indije in (b) 90 dni v katerem koli 180-dnevnem obdobju na ozemlju Republike Slovenije.

2. člen

Opredelitev pojmov

V tem sporazumu:

»diplomatski potni list« pomeni diplomatski potni list Republike Slovenije in diplomatski potni list Republike Indije.

3. člen

Pogoji za oprostitev vizumske obveznosti in bivanje

1. Oprostitev vizumske obveznosti po tem sporazumu ne vpliva na zakone pogodbenic, ki urejajo pogoje za vstop in kratkoročno bivanje. Pogodbenici si pridržujeta pravico, da zavrneta vstop in kratkoročno bivanje na svojem ozemlju, če ni izpolnjen eden ali več od teh pogojev.

Državljani Republike Slovenije, ki so upravičeni do ugodnosti po tem sporazumu, med svojim bivanjem spoštujejo zakone in predpise, ki veljajo na ozemlju Republike Indije.

4. člen

Trajanje bivanja

1. Državljani Republike Indije, imetniki veljavnih diplomatskih potnih listov, lahko ostanejo na ozemlju Republike Slovenije največ 90 dni v katerem koli 180-dnevnem obdobju.

Državljani Republike Slovenije, imetniki veljavnih diplomatskih potnih listov, lahko ostanejo na ozemlju Republike Indije največ tri mesece.

Ta sporazum ne vpliva na možnost pogodbenic, da v skladu s svojim notranjim pravom podaljšata čas bivanja na več kot tri mesece.

5. člen

Izmenjava vzorcev potnih listov

1. Pogodbenici si po diplomatski poti izmenjata vzorce svojih veljavnih diplomatskih potnih listov najpozneje 30 dni po podpisu sporazuma.

Ob uvedbi novih ali spremembah obstoječih diplomatskih potnih listov si pogodbenici najpozneje 30 dni pred začetkom njihove uporabe po diplomatski poti izmenjata vzorce novih ali spremenjenih potnih listov skupaj s podrobnimi informacijami o varnostnih elementih in začetku uporabe.

6. člen

Končne določbe

1. Sporazum začne veljati prvega dne naslednjega meseca po dnevu prejema zadnjega od pisnih uradnih obvestil, s katerima se pogodbenici obvestita, da so končani notranjepravni postopki za začetek njegove veljavnosti.

Sporazum se sklene za nedoločen čas. Pogodbenici ga lahko odpovesta s pisnim uradnim obvestilom drugi pogodbenici. Sporazum preneha veljati devetdeset dni od prejema takega obvestila.

Sporazum se lahko spremeni s pisnim soglasjem obeh pogodbenic. Spremembe začnejo veljati v skladu s prvim odstavkom tega člena.

Pogodbenica lahko začasno v celoti ali delno preneha izvajati ta sporazum. Drugo pogodbenico o tej odločitvi uradno obvesti najmanj dva meseca vnaprej. Pogodbenica, ki je začasno prenehala izvajati ta sporazum, nemudoma obvesti drugo pogodbenico, ko se razlogi za začasno prenehanje izvajanja odpravijo. Ukrep preneha veljati na dan, ko druga pogodbenica prejme uradno obvestilo.

Nesoglasja ali spori, povezani z izvajanjem določb sporazuma, se rešujejo prijateljsko s posvetovanji ali pogajanji med pogodbenicama in se ne predložijo tretji strani ali mednarodnemu sodišču.

Sklenjeno v New Delhiju dne 11. novembra 2013 v dveh izvirnikih v slovenskem, hindujskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah v razlagi prevlada angleško besedilo.

A G R E E M E N T <br /> between the Government of the Republic of Slovenia and the Government of the Republic of India on Short-Stay Visa Waiver for Holders of Diplomatic Passports

The Government of the Republic of Slovenia and the Government of the Republic of India (hereinafter the "Contracting Parties")

Desiring to safeguard the principle of reciprocity and facilitate travel by ensuring visa free entry and short stay for the citizens of Contracting Parties who are holders of valid diplomatic passports;

Respecting their internal regulations and procedures;

With a view to further developing friendly relations and continuing to strengthen close ties between the Contracting Parties;

Have agreed as follows:

Article 1

Purpose and scope

In accordance with the provisions of this Agreement, citizens of the Contracting Parties, holders of a valid diplomatic passport, shall be allowed to enter into, transit through and stay in the territory of the other Contracting Party without a visa for a (a) three months in the territory of Republic of India and (b) 90 days in any 180-day period in the territory of Republic of Slovenia.

Article 2

Definitions

For the purpose of this Agreement:

Diplomatic passport shall refer to the diplomatic passport of the Republic of Slovenia and to the diplomatic passport of the Republic of India.

Article 3

Conditions of visa waiver and stay

1. The visa waiver provided by this Agreement shall apply without prejudice to the laws of the Contracting Parties on the conditions of entry and short stay. The Contracting Parties reserve the right to refuse entry into and short stay in their respective territories if one or more of these conditions are not met.

2. During their stay, the citizens of the Republic of Slovenia benefiting from this Agreement shall abide by the laws and regulations in force in the territory of the Republic of India.

3. During their stay, the nationals of the Republic of India benefiting from this Agreement shall abide by the laws and regulations in force in the territory of the Republic of Slovenia.

Article 4

Duration of stay

1. The citizens of the Republic of India holding a valid diplomatic passport may stay in the territory of the Republic of Slovenia for a period not exceeding 90 days in any 180-day period.

2. The citizens of the Republic of Slovenia holding a valid diplomatic passport may stay in the territory of the Republic of India for a period not exceeding three months.

3. This Agreement shall not affect the possibility for the Contracting Parties to extend the period of stay beyond three months in accordance with their respective national law.

Article 5

Exchange of specimens of passports

1. The Contracting Parties shall exchange, through diplomatic channels, specimens of their valid diplomatic passports no later than 30 days following the date of signing of this Agreement.

2. In case of introduction of new diplomatic passports or modification of the existing ones, the Contracting Parties shall convey to each other, through diplomatic channels, specimens of new or modified passports, including the details of their security features and applicability, no later than 30 days prior to its application.

Article 6

Final provisions

1. The Agreement shall enter into force on the first day of the month following the date of receipt of the last written notification, by which the Contracting Parties notify each other that their internal legal procedures for its entry into force have been completed.

2. The Agreement shall be concluded for an indefinite period of time. Either Contracting Party may terminate it by giving written notice to the other. The Agreement shall cease to apply ninety days following the receipt of such notification.

3. The Agreement may be amended by written agreement of the Contracting Parties. The amendments shall take effect in compliance with paragraph 1 hereof.

4. Either Contracting Party may suspend the Agreement in whole or in part. The decision on the suspension shall be notified to the other Contracting Party no later than two months in advance. The Contracting Party that has suspended the application of this Agreement shall immediately notify the other Contracting Party once the reasons for suspension no longer exist. The suspension of this Agreement shall cease to apply on the date of receipt of such notification by the other Contracting Party.

5. Any differences or dispute arising out of the implementation of provisions of the Agreement shall be settled amicably through consultations or negotiation between the Contracting Parties without reference to any third party or an international tribunal.

DONE at New Delhi on 11th November 2013, in two originals in the Slovenian, Hindi and English languages, each of these texts being equally authentic. In case of differences in interpretation, the English text shall prevail.
