2. člen

Dodatni protokol se v izvirniku v slovenskem in angleškem jeziku glasi:*

D O D A T N I     P R O T O K O L K <BR>ZAČASNEMU SPORAZUMU O TRGOVINI IN ZADEVAH V ZVEZI S TRGOVINO MED REPUBLIKO SLOVENIJO NA ENI STRANI IN EVROPSKO SKUPNOSTJO, EVROPSKO SKUPNOSTJO ZA PREMOG IN JEKLO TER EVROPSKO SKUPNOSTJO ZA JEDRSKO ENERGIJO NA DRUGI STRANI, IN K EVROPSKEMU SPORAZUMU MED REPUBLIKO SLOVENIJO NA ENI STRANI TER EVROPSKIMI SKUPNOSTMI IN NJIHOVIMI DRŽAVAMI ČLANICAMI NA DRUGI STRANI

EVROPSKA SKUPNOST, v nadaljnjem besedilu “Skupnost“,

REPUBLIKA SLOVENIJA, v nadaljnjem besedilu “Slovenija“,

ker je bil Evropski sporazum o pridružitvi med Evropskimi skupnostmi in njihovimi državami članicami, ki delujejo v okviru Evropske unije, na eni strani in Republiko Slovenijo na drugi strani podpisan v Luksemburgu 10. junija 1996 in še ni začel veljati,

ker do začetka veljavnosti Evropskega sporazuma veljajo določbe tega sporazuma o trgovini in zadevah v zvezi s trgovino od 1. januarja 1997 iz Začasnega sporazuma o trgovini in zadevah v zvezi s trgovino med Evropsko skupnostjo, Evropsko skupnostjo za premog in jeklo in Evropsko skupnostjo za jedrsko energijo na eni strani in Republiko Slovenijo na drugi strani (v nadaljnjem besedilu “Začasni sporazum“), podpisanega v Bruslju 11. novembra 1996,

ker Priloga VI tako Evropskega sporazuma kot do začetka njegove veljavnosti Začasnega sporazuma določa posebne ugodnosti za uvoz v Skupnost neomejenih količin zamrznjenega ajvarja, izdelka, ki izvira iz Slovenije,

ker bi bilo treba upoštevati posebne ugodnosti, ki jih tradicionalno uživa Slovenija za zamrznjeni in nezamrznjeni ajvar po Sporazumu o sodelovanju s Slovenijo, ker je ajvar specifičen izdelek in se ne izdeluje v Skupnosti,

ker bi morala iz teh razlogov Evropski sporazum in do začetka njegove veljavnosti Začasni sporazum za uvoz nezamrznjenega ajvarja podeliti iste posebne ugodnosti, kot so podeljene za zamrznjeni ajvar,

STA SE ODLOČILI skleniti ta protokol in sta v ta namen za svoja pooblaščenca imenovali:

KI STA SE po medsebojni izmenjavi pooblastil v dobri in pravilni obliki

SPORAZUMELA O NASLEDNJEM:

1. člen

Od dne začetka veljavnosti tega protokola se Evropski sporazum in do začetka njegove veljavnosti Začasni sporazum spremenita in dopolnita tako, da se vstavi naslednje ugodnosti v Prilogi VI obeh sporazumov:

2. člen

Protokol je sestavni del Začasnega sporazuma in Evropskega sporazuma.

3. člen

Protokol začne veljati po uradnem obvestilu o postopkih za odobritev.

4. člen

Protokol je sestavljen v dveh izvodih v slovenskem, angleškem, danskem, finskem, francoskem, grškem, italijanskem, nemškem, nizozemskem, portugalskem, španskem in švedskem jeziku, pri čemer je vsako od teh besedil enako verodostojno.

A D D I T I O N A L     P R O T O C O L <BR>TO THE INTERIM AGREEMENT ON TRADE AND TRADE-RELATED MATTERS BETWEEN THE EUROPEAN COMMUNITY, THE EUROPEAN COAL AND STEEL COMMUNITY AND THE EUROPEAN ATOMIC ENERGY COMMUNITY, OF THE ONE PART, AND THE REPUBLIC OF SLOVENIA, OF THE OTHER PART, AND TO THE EUROPE AGREEMENT BETWEEN THE EUROPEAN COMMUNITIES AND THEIR MEMBER STATES, OF THE ONE PART, AND THE REPUBLIC OF SLOVENIA, OF THE OTHER PART

THE EUROPEAN COMMUNITY, hereinafter referred to as “the Community“,
    THE REPUBLIC OF SLOVENIA, hereinafter referred to as “Slovenia“,
    Whereas the Europe Agreement establishing an association between the European Communities and their Member States, acting within the framework of the European Union, of the one part, and the Republic of Slovenia, of the other part, was signed in Luxembourg on 10 June 1996, and has not yet entered into force;
    Whereas, pending the entry into force of the Europe Agreement, provisions thereof on trade and trade-related matters have been brought into force since 1 January 1997 by the Interim Agreement on trade and trade-related matters between the European Community, the European Coal and Steel Community and the European Atomic Energy Community, of the one part, and the Republic of Slovenia, of the other part, (hereinafter called “the Interim Agreement“), signed in Brussels on 11 November 1996;
    Whereas the Europe Agreement and, pending its entry into force, the Interim Agreement provides, in Annex VI of each, for preferential treatment for imports into the Community of an unlimited volume of frozen Ajvar produce originating in Slovenia;
    Whereas the preferential treatment traditionally enjoyed by Slovenia for frozen and non-frozen Ajvar under the Cooperation Agreement with Slovenia should be taken into account; whereas Ajvar is a specific product and is not produced in the Community;
    Whereas for these reasons, the Europe Agreement and, pending its entry into force, the Interim Agreement, should grant to imports of non-frozen Ajvar the same preferential treatment as that granted to frozen Ajvar,
    HAVE DECIDED to conclude this Protocol and to this end have designated as their plenipotentiaries:

HAVE AGREED AS FOLLOWS:

Article 1

From the date of entry into force of this Protocol, the Europe Agreement, and, pending its entry into force, the Interim Agreement shall be amended by the inclusion of the following concession in Annex VI of each:

Article 2

This Protocol shall form an integral part of the Interim Agreement and of the Europe Agreement.

Article 3

This Protocol shall enter into force following notification of approval procedures.

Article 4

This Protocol shall be drawn up in duplicate in the Danish, Dutch, English, Finnish, French, German, Greek, Italian, Portuguese, Spanish, Swedish and Slovenian languages, each of these texts being equally authentic.
