POVZETEK
25. januarja 2009 so bolivijski državljani na referendumu potrdili novo ustavo. Njena ustanovna zgradba je zapletena in na izviren način ureja razdelitev oblasti. Pomnoževanje teles odločanja in njihove široke pristojnosti preprečujejo prevlado enega samega telesa in hkrati zahtevajo njihovo tesno medsebojno sodelovanje ter stalno pogajanje pri izvajanju državnih politik. Osrednja vloga v novi ureditvi pa nedvomno pripada ljustvu, ki s svojimi pristojnostmi razsodnika lahko pomembno vpliva na razmerje moči v državi in ima v rokah celo prihodnost nove ustave.
SUMMARY
On 25 January 2009, the Bolivians approved a new constitution defining their countryas “the United Social State of Pluri-national Communitarian Law” and increasing therights of the Bolivia’s majority of indigenous population. The article presents andanalyses a lengthy text of 411 articles through its decisionmaking system, which isgranting a significant role to the people. The new constitution has remodeled the former Bolivian administrative division and has introduced a multi-layered autonomy system. Therefore, a certain degree of cooperation is required between public institutions such as a dialogue between the legislative, executive and judicial branches in the process of appointing to the highest state positions. The same system of check and balances is mandated for the ratification of international treaties, for enactment of laws or in the constitutional revision process.
