ZPZ uvaja institut partnerske zveze in mu na vseh pravnih področjih pripisuje enake pravne posledice, kot jih ima zakonska zveza. S tem je zakonodajalec naredil pomemben korak k izboljšanju (pravnega) varstva istospolnih parov, še vedno pa ostajajo institut zakonske zveze ter možnosti snovanja družine prihranjeni za heteroseksualne skupnosti. Istospolni pari v Sloveniji otroka ne morejo posvojiti skupaj, saj ta možnost ostaja pridržana zgolj zakoncema, lahko pa otroka vsak od partnerjev posvoji sam. Do postopkov oploditve z biomedicinsko pomočjo ostajajo upravičeni zgolj moški in ženske v zakonski zvezi ter zunajzakonski skupnosti. Prav tako ni možnosti, da bi istospolni partnerji postali starši s pomočjo nadomestnega materinstva. ZPZ o razlogih za preostala razlikovanja istospolnih in raznospolnih parov molči, zato je ustrezen premislek o utemeljenosti ureditve.

The Civil Union Act introduces the civil union and equalises its legal consequences in all areas with the consequences of marriage. While the legislature has thus made an important step towards improving the (legal) protection of same-sex couples, marriage and possibilities of establishing a family remain reserved for heterosexual unions. As joint adoption is reserved for spouses, same-sex couples in Slovenia cannot adopt a child together, but each of the partners can only adopt a child by himor herself. Only married men and women or men and women living in common-law marriage have the right to access procedures of biomedically-assisted procreation. There is also no possibility for same-sex couples to become parents through surrogacy. The Civil Union Act provides no reasons for the remaining different treatment, and such calls for a reflection on the justification of the existing regulation.
