Prispevek obravnava uporabo nomotehničnih pravil pri prenosu direktiv Evropske unije v slovenski pravni red. Najprej je treba ugotoviti, ali je vsebina direktive v pravnem redu že normirana in kako. Z ožjim in širšim pravno-sistemskim pogledom pridemo do odgovorov, ali in kako je glede na direktivo treba bodisi urediti vsebino povsem na novo bodisi spremeniti ali dopolniti obstoječe predpise ali pa morda celo ugotoviti, da je zadevno področje že zadovoljivo urejeno. Avtorica obravnava najpogostejše napake pri prenašanju direktiv, ki jih mora odpraviti pravnik redaktor. Prenašanje vsebine direktive nikakor ne pomeni nekritičnega dobesednega prenosa vsebine, ne da bi jo smiselno in z razumevanjem umestili znotraj začrtanih konceptov določene ureditve na nacionalni ravni. Pri tem se odpirajo tudi vprašanja razmejitve med harmonizacijo in unifikacijo nacionalnih predpisov znotraj EU.

The paper discusses the use of nomotechnical rules in transposing the European Union’s directives into Slovenian legal order. It should be determined first whether the content of the directive has already been regulated in the national legal order and in what way. A narrower and a wider legal-systemic view should give the answers as to whether, in the light of the directive, the content should be regulated from scratch or the existing regulation should be modified or amended, or maybe even find that the area is already sufficiently regulated. The author discusses the most common errors in transposition of directives, which should be eliminated by a lawyer editor. Transposing of the contents of a directive should not equal uncritical verbatim reproduction of its content, without its rational positioning within the concepts existing at the national level. The issue of boundaries between the harmonization and the unification of national rules within the EU also arises.
