POVZETEK
V procesu preoblikovanja nekdanje družbene lastnine v klasično lastnino po letu 1991 so se v številnih primerih kot novi lastniki objektov javne infrastrukture, zlasti cest in drugih javnih površin, v zemljiško knjigo vpisali zasebni subjekti, ki so s tem vsaj formalno pridobili pravico preprečiti javno rabo teh nepremičnin. Tovrstne zlorabe je omogočala zlasti razdrobljena zakonodaja, ki je urejala lastniški status javne infrastrukture, in neurejenost zemljiške knjige. Država in občine so predolgo odlašali z razglasitvijo statusa javnega dobra na javnih površinah, ažuriranjem vpisov v zemljiški knjigi in uporabo pravnih sredstev za zavarovanje javnega interesa. Vseeno je z upoštevanjem celotne relevantne zakonodaje ter pravilno uporabo instituta dobre vere objekte javne infrastrukture mogoče povrniti v javno last. V poštev pridejo tudi nekatera posebna pravila iz prehodnih določb ZGO1 in ZVEtL.
SUMMARY
During the transformation of the former social property into classic form of property after 1991, private entities managed, in many cases, to be entered in the land register as the new owners of public infrastructure objects, esp. roads and other public spaces, and thereby formally gaining the right to prevent public use of this property. Such abuses were made possible by the fragmented legislation on the ownership of public infrastructure and by the inaccurate land register records. The state and municipalities were too reluctant in declaring the public legal status of public infrastructure, updating land register records and using legal remedies for the protection of the public interest. Nevertheless, it remains possible to reclaim public infrastructure objects into public ownership by taking into account the entire set of rules contained in privatisation legislation, and through application of the instrument of good faith. Certain special rules contained in the transitory provisions of the Construction Act and the Establishment of Floor Ownership Act may also be used for this purpose.
