POVZETEK
Članek obravnava udeležbo pri mednarodnih hudodelstvih, zlasti z vidika sodne prakse Mednarodnega kazenskega sodišča (MKS). Ta tema je bila vedno sporna z vidika kazenskega prava, ker so se vedno pojavljala stališča, da običajne oblike udeležbe ne zadostujejo. Članek vsebuje najprej primerjalnopravni pregled določenih vprašanj v zvezi z udeležbo, nato zgodovinski pregled ureditve udeležbe v mednarodnem kazenskem pravu ter v Rimskem statutu. Glavni poudarek pa je na analizi dosedanje sodne prakse MKS na to temo, zlasti glede razlikovanja med storilstvom in udeležbo v ožjem pomenu in primerno opredelitvijo ter uporabo posrednega storilstva. Članek prinaša nekaj ugotovitev, in sicer: odnos MKS do oblik udeležbe je drugačen kot odnos prejšnjih sodišč (lahko bi rekli, da uporablja stare oblike v prenovljeni različici), poleg tega pa je MKS zavzelo restriktivno stališče do storilstva.
SUMMARY
This article focuses on participation in international crimes in the case law of International criminal court (ICC). This topic has always been very notorious from the criminal law point of view, since it has been a prevalent opinion that usual forms of participation, which have been developed in national criminal jurisdictions, do not suffice. Article starts with a presentation of the theory of participation and different forms of participation in common and civil law and continues with short historical overview on participation in international criminal law and its codification in the Rome Statute. However, main focus of this article lies on the ICC’s jurisprudence on this subject. Main questions, which have been dealt with, are the distinction between the perpetrators and accessories and the appropriate definition and use of indirect perpetration. Few conclusions are made in the article. First, the attitude of the ICC towards the forms of participation is different than the ICTY’s and other courts’ attitude. It could be said that more traditional forms of participation are being used, but in a new, reformed way. ICC also took a stand of restrictive comprehension of perpetration.
