POVZETEK
Avtor, doc. dr. Janez Pogorelec, se v svojem prispevku za X. nomotehnične dneve z naslovom Slovenski pristop k pravnemu normiranju ali zakaj smo tam, kjer smo sprašuje, ali ni eden največjih posamičnih razlogov za tako neuspešno spopadanje Republike Slovenije z gospodarsko in finančno krizo, kot smo mu priča v zadnjih letih, v resnici neprimeren pristop k pravnem normiranju, kakršnega brez izjeme prakticirajo vse vlade zadnjih desetih ali petnajstih let. Analizira glavne vzroke za podoptimalno sposobnost naše javne uprave za pripravo in izvajanje predpisov in ugotavlja, da kljub temu, da je bila v zadnjih letih sprejeta resolucija o normativni dejavnosti, pa spremembe poslovnika vlade kljub priporočilom OECD, nomotehničnim smernicam, izboljševanju informacijske podpore situacija na področju kvalitete pravnega normiranja ostaja bolj ali manj nespremenjena, še več, kaže, da krizna situacija politiki celo služi kot izgovor za še slabše upoštevanje prava in pravil dobrega pravnega normiranja, čeprav bi v resnici moralo biti ravno nasprotno. Avtor se kritično ozre tudi na stanje duha v državni upravi, ki bi morala biti bolj suverena, imeti svoja stališča in jih odločneje zagovarjati.
SUMMARY
In his article contributed for 10th Days of Legal Drafting with the title »The Slovenian Approach to Legal Drafting or Why Have We Found Ourselves Where We are Now?« the author, Janez Pogorelec, PhD, speculates about a possible major reason for inefficient battle of the Republic of Slovenia against the economic and financial crisis experienced in the past years, which could be actually found in an inadequate approach to legal drafting that has been practised by all our governments in the last ten or fifteen years. He analyses the main reasons for suboptimal capabilities of our public administration to draft and implement the regulations, since despite the resolution on the normative activities which was adopted in the last years, changes of the Government’s rules of procedure, the OECD recommendations, legal drafting guidelines, improvement of information system support, the situation in relation to the quality of legal drafting has remained more or less unchanged, even more, it seems that the crisis serves to our politicians as a pretext for even less consideration of the law and the rules of efficient legal drafting, although the situation should be just the opposite. Furthermore, the author also demonstrates his critical attitude towards the state of mind in the public administration, which should be more sovereign and decisively defending their positions.
