Z dnem začetka uporabe Zakona o partnerski zvezi (ZPZ) je začelo teči šestmesečno prehodno obdobje, po koncu katerega se bo prenehal uporabljati Zakon o registraciji istospolne partnerske skupnosti (ZRIPS), s čimer bo tudi v celoti končan prehod iz stare na novo obliko partnerske skupnosti. Ob dejstvu, da nova ureditev precej posega v dosedanjo, se odpira razmeroma kompleksno vprašanje prehoda iz ene pravne ureditve v drugo, ki pa je urejeno v prehodnih oziroma končnih določbah ZPZ. Režim prehodne ureditve temelji na ex lege preoblikovanju registrirane partnerske skupnosti v partnersko zvezo po poteku prehodnega obdobja, hkrati pa obstaja možnost predčasne izjave volje bodisi o preoblikovanju bodisi o prenehanju registrirane partnerske skupnosti.

On the date when the Civil Union Act became applicable a six-month transition period has begun. After the end of that period, the Civil Partnership Registration Act will cease to apply, which entails that by then the transition from the old to the new form of partnership will be fully completed. Given the fact that the new legal regulation fully replaces the existing-one, relatively complex issues of transition from one legal regulation to another arise. The transitional regulation is determined by the transitional and final provisions of the Civil Union Act and is based on an ex lege transformation of registered same-sex civil partnerships into civil unions after the expiry of the transitional period, with the additional possibility of an early declaration of intent on either transformation or termination of a registered partnership.

The Transition from a Registered Same-Sex Civil Partnership to a Civil Union
