of International Development Cooperation between the Government of the Republic of Slovenia and the Government of Montenegro for the period 2016–2017
Based on the Agreement on Development Cooperation between the Government of the Republic of Slovenia and the Government of Montenegro, signed on 7 February 2008,
Have agreed on the following:
I FUNDS EARMARKED FOR BILATERAL DEVELOPMENT COOPERATION BETWEEN THE REPUBLIC OF SLOVENIA AND MONTENEGRO FOR THE PERIOD 2016–2017
Article 1
In the Framework Programme of International Development Cooperation and Humanitarian Assistance of the Republic of Slovenia for the period 2016–2019, the Government of the Republic of Slovenia has earmarked funds in the approximate amount of EUR 1,287,600 for the period 2016–2017 for bilateral development cooperation between the Republic of Slovenia and Montenegro.
II DEVELOPMENT PROJECTS AIMED AT ENHANCING ECONOMIC AND SOCIAL INFRASTRUCTURE
Article 2
1. In the Framework Programme of International Development Cooperation and Humanitarian Assistance of the Republic of Slovenia for the period 2016–2019, the Government of the Republic of Slovenia has earmarked funds in the approximate amount of EUR 768,000 for the period 2016–2017 in support of development projects aimed at enhancing economic and social infrastructure in Montenegro.
2. When selecting projects aimed at enhancing economic and social infrastructure, the Parties took into account the strategic priorities of Montenegro, which focus on sustainable development, ecology and environmental protection, with a special emphasis on the least developed parts of Montenegro and the development of quality tourism and ecotourism as one of Montenegro's economic policy priorities.
3. In the period 2016–2017, the Parties plan to undertake the following new projects in the field of economic and social infrastructure:
1 Management of public environmental and tourist infrastructure in the Municipality of Žabljak;
2 Purchase of an utility vehicle and garbage containers;
3 Construction of a biological treatment plant in Vranjina;
4 Renovation of waste sorting plant in the Municipality of Plav;
5 Sustainable renovation of the waste sorting plant in the Municipality of Žabljak;
6 Remediation, reconstruction and building of the water supply network in Žabljak.
4. If some of the projects listed in paragraph 3 of this Article are not implemented and if the conditions for the inclusion of additional projects are met, the Parties agree to consider undertaking the project ‘Remediation, reconstruction and building of the water supply network in Žabljak’, which shall be agreed upon by the Parties in an Annex to this Agreement.
Article 3
1. In the case of projects aimed at enhancing economic and social infrastructure, the standard donation of the Republic of Slovenia does not exceed 40%. The remaining funds are to be ensured by the recipient country.
2. Any changes to the co-financing share must be authorized by the Ministry of Foreign Affairs of the Republic of Slovenia on a case-by-case basis.
3. The recipient country decides at its own discretion how to close the financial construction of a project.
Article 4
The recipient country selects a contractor in accordance with its national legislation regulating public finances and public procurement. In special cases in which the Republic of Slovenia provides the majority of the funding, the Centre for International Cooperation and Development, in agreement with the donation recipient, shall select a contractor on the basis of a tender published in the Republic of Slovenia in accordance with Slovenian legislation on public finances and public procurement.
III TECHNICAL ASSISTANCE
Article 5
The Parties have agreed to provide funds in the approximate amount of EUR 464,600 for technical assistance.
Article 6
1. Taking into account the active support of the Republic of Slovenia for Montenegro with regard to its prospective membership of the European Union and adoption of EU standards and norms, in the period 2016–2017, the Republic of Slovenia will provide, through its ministries, their agencies and government offices, Montenegro with expert technical assistance in an amount up to EUR 167,000.
2. From the funds allocated for international development assistance of the Ministry of Defense of the Republic of Slovenia, EUR 237,600 will be channelled for consulting and transfer of Slovenian knowledge and experiences to the Montenegrin defense institutions.
Article 7
The Republic of Slovenia will provide Montenegro with expert technical assistance in the field of internal audit in public sector in the amount of EUR 60,000 in 2016, to be implemented by the International organization Centre for Excellence in Finance.
IV OTHER FORMS OF COOPERATION
Article 8
1. The Parties shall promote development activities undertaken in Montenegro by non-governmental organizations from the Republic of Slovenia, and other forms of bilateral development cooperation, such as projects at the regional level or for several partner countries concurrently.
2. In the Framework Programme of International Development Cooperation and Humanitarian Assistance for the period 2016–2019, the Government of the Republic of Slovenia has earmarked EUR 55,000 for co-financing activities of non-governmental organizations, namely EUR 25,000 for the conclusion of the three-year project and EUR 30,000 for a project selected in a public tender.
V FINAL PROVISIONS
Article 9
Specific activities and details of the implementation of the Programme shall be coordinated by the Joint Committee for Development Cooperation of the Ministry of Foreign Affairs of the Republic of Slovenia and the Ministry of Foreign Affairs of Montenegro.
Article 10
If any problems arise during the realization of specific projects, the identification of additional development projects or other unforeseen developments in the Programme's implementation, the Parties may agree, via the Joint Committee, or other form of mutual communication, to amend the list of selected projects. Such arrangements shall be formalised in the form of an annex, which shall constitute an integral part of the Programme and enter into force in accordance with the provisions of Article 11 hereof.
Article 11
The Programme shall be provisionally applied from the date of its signature. The Programme shall enter into force on the thirtieth day following its signature and shall remain in force until 31 December 2017. Activities that are still underway or not concluded by 31 December 2017 shall be subject to the provisions of the Agreement on Development Cooperation between the Government of the Republic of Slovenia and the Government of Montenegro until their conclusion, unless otherwise agreed by the Parties.
