Mediacija v družinskih zadevah se izvaja, ko gre za konflikte med družinskimi člani. Praviloma gre za nekdanja zakonca ali zunajzakonska partnerja, ki se razhajata. Če imata skupne mladoletne otroke, morata urediti odprta vprašanja glede varstva in skrbi zanje, preživnine in stikov. Če nimata skupnih otrok, se lahko pojavijo spori glede delitve skupnega premoženja, pravice do najemnega stanovanja, preživljanja enega od zakoncev, ki nima sredstev. O vsem tem se lahko sporazumno dogovorita ob pomoči mediatorja. Mediacija se uporablja tudi za druge spore, ki izhajajo iz družinskih razmerij. Izvaja se lahko pred in med sodnim postopkom ali po njem. V družinski mediaciji veljajo temeljna načela prostovoljnosti, zaupnosti, nepristranskosti in druga, v ospredju pa je največja korist otroka, ki prevlada nad temeljnimi načeli. Mediatorji v družinskih mediacijah morajo biti še zlasti pozorni na morebitno nasilje v družini in biti posebej usposobljeni.

If they have minor children together, they must resolve outstanding issues regarding the children’s protection and care, maintenance payments, and contact arrangements. If they do not have children together, disputes may emerge regarding the division of joint property, the right to use a rented home, and the support of one spouse who is without financial means. All of these matters can be settled with the assistance of a mediator. Mediation is also employed in other disputes arising from family relationships. It may be carried out before, during, or after court proceedings. Family mediation is based on fundamental principles such as voluntariness, confidentiality, and impartiality, among others. However, the best interests of the child take precedence over these fundamental principles. Mediators involved in family mediation must be especially vigilant for any signs of domestic violence and must be specifically trained to address such situations.
