POVZETEK
Prispevek obravnava institute zasebnega prava, s katerimi lahko zagotovimo trajnostno proizvodnjo in potrošnjo elektronskih naprav. Ker so elektronski odpadki najhitreje rastoča skupina odpadkov, je treba preprečiti njihov nastanek, kar lahko dosežemo s podaljševanjem življenjske dobe elektronskih naprav in njihovim popravilom. Zato so v prispevku predstavljene pravne možnosti preprečitve načrtovane zastarelosti, s katero podjetja namerno proizvedejo proizvode s krajšo življenjsko dobo in tako potrošnike spodbudijo v nakup nove elektronske naprave ter si s tem povečajo prodajo in dobiček. Ker je eden od načinov odprave zastarelosti popravilo, je prispevek osredotočen tudi na pravico do popravila, s katero bi potrošnikom omogočili popravilo njihovih elektronskih naprav in posledično zmanjšali količino elektronskih odpadkov. Potrošniki imajo že danes zagotovljeno možnost popravila v okviru prodajalčeve odgovornosti za stvarne napake in morebitne proizvajalčeve ali prodajalčeve tržne garancije. Ker pa so jamčevalni in garancijski roki razmeroma kratki, po njihovem izteku pa popravilo oteženo ali celo onemogočeno s številnimi stvarnimi in pravnimi ovirami, avtorica v prispevku predstavi tudi nekatere omenjene ovire in nakaže konflikte, ki nastajajo, ko potrošniki želijo popraviti svojo elektronsko napravo.
SUMMARY
The article examines private law institutes, with which we can ensure sustainable production and consumption of electronic devices. As electronic waste is the fastest growing group of waste, it is crucial to prevent its generation, which can be achieved by extending the lifetime of electronic devices and repairing them. This article, therefore, presents legal options to prevent planned obsolescence, whereby businesses deliberately produce products with a shorter lifespan to encourage consumers to buy a new electronic device and thereby increase their sales and profits. As one of the ways to eliminate obsolescence is through repair, the article also focuses on the right to repair, which would allow consumers to repair their electronic devices and consequently reduce e-waste. Consumers are already guaranteed the possibility of repair under the seller‘s liability for material defects and the potential manufacturer‘s or seller‘s commercial guarantee. However, as warranty and guarantee periods are relatively short and, once they expire, the repair is made difficult or even impossible by numerous of practical and legal obstacles, the author also presents some of these obstacles and highlights the conflicts that arise when consumers want to repair their electronic device.
